VANCOUVER, January 5, 2006 (LifeSiteNews.com) - The BC Human Rights Tribunal is being asked to discover a new “sexual orientation.” The Vancouver Sun reported December 30, that a self-described “pagan” is accusing the Vancouver police of discrimination for refusing him a license to drive a limousine because of his involvement in the “bondage and discipline, domination and submission, sadism and masochism” (BDSM) underworld.

A Vancouver man, Peter Hayes, has accused the Vancouver police of illegal discrimination because of his involvement in BDSM. Hayes says that he lost a potential job as a limousine driver when police refused him a chauffeur's permit and has taken his case to the Human Rights Tribunal.

Sexual orientation is only about the gender of the people with whom you wish to sleep. BDSM is an activity.

Both are matters of privacy, as long as full consent is given by all parties.

I am personally touchy about the misuse of sexual orientation; as a transsexual women, I am often asked if my identity is a matter of being gay.

Sexual orientation is not a catchall term for either detractors or adherents of sexual experience beyond the one man-one woman missionary position.

While much of this may seem bizarre to the less adventuresome within the community, it all boils down to two words. Consent-- and Privacy. When they refer to consenting adults, that's exactly what they mean. Two people capable of making informed choices that are of proper age. This, like many other things, is a matter of personal privacy and should not be found as a question on a job interview.It is just as demeaning as being asked what one's religion is- or how one votes.
As for bdsm, as in many other facets of sex play there are usually certain rules set between long term partners before the game ever begins. This is to prevent real injuries to either one and keeps the scene from degrading into one of torture without consent.
While there are those that sometimes do ignore the rules, these are few and far between and are usually pathological criminals. What the military does is another matter during interrogations. This does need to be looked into. Those who set themselves above an enemy should not use their tactics as a matter of course.
If he has no criminal record, then they have no right to invade his privacy and condemn him for crimes they think he- might -commit. this would be like refusing a teen ager a license because they are afraid that he might cause an accident because of his age.

I don't think it's a sexual orientation. It obviously does trip the triggers of a number of people, but so does lingerie, chocolate, shoes, gloves... So I have to agree that they may lose by choosing this tactic. It's a privacy issue, and honestly, they should be smart enough to push that to it's limits.

The difference between BDSM and torture is simple: CONSENT. A prisoner cannot consent. An animal cannot consent. A child cannot make informed consent based on an understanding of long-range consequences (you can convince -- maybe not all, but many -- children to agree to almost anything, especially if you are an authority figure or one whose approval they crave.)

Why is this a slippery slope? What could be more rock solid than Adult + consent = not the business of the neighbors, the co-workers, the boss, or the government? If the person in question can't do his job because of the handcuffs, the bruises, or his inability to keep his mind on the job, that's a whole 'nother issue that does not need to bring what he does with who into the question. It's a simple matter of not performing the job as expected. End of story and thanks for your time.

And yes, I know that the consent thing can slide into the realms of spousal or partner abuse, but that's not the issue here. The issue here is whether what you do behind closed doors with consenting adults should affect your ability to earn a paycheck.

How many of the people making these decisions would really like that kind of scrutiny turned on them?

In a previous article (go back a couple of pages, you'll find it, I think) in a more reputable Vacouver BC newspaper it was stated that the police had talked to the man's ex-SO and *she* had made allegations that he was part of a cult and practiced BDSM.

It was alleged in the same article that the police officer, in verbally informing the man that they were denying him a limo license, indicated that they were doing so because he was into a cult of BDSM (also referencing something to do with Tarnsmen of Gor?) and that they *did not want him recruiting passengers* (emphasis mine) .

Can anyone say 'specious'?

I knew you could.

Even if this was the case (that the man intended to do as they alleged he might) , isn't it between himself, his employer and his passengers?
I mean, if he pulls this stuff and the company's profits go down (and there are complaints) he's going to be out of a job pretty quickly (that's economics) .

And I just don't see how anyone can recruit effectively or safely anyone to do anything while driving.

Even if the man was an alleged pedophile (which is all he would be at this stage) it is not grounds for denying him a limo license. It *IS* grounds for a further investigation, and, if proved to be true, arrest, trial and encarceration. But, since driving a limo does not usually involve ferrying unaccompanied children (unless the limo license in BC includes school buses) , there is no reason to deny him a license.

In short, the cops are wrong.
They're very very wrong.
I hope that the commission rules against them.
But never mind 'sensitivity training', try making them take a logic class and sentence them to take classes that review (in depth) the body of laws they're supposed to be upholding (should take YEARS) ..

Listen to the statement of the police: they're arguing that it is legally acceptable to discriminate on the base of preferences. So why should this person NOT try to overcome a blatant act of institutionalized discrimination? There are sharp legal differences between what consenting adults prefer, as opposed to adults mixing with minors or animals, heaven forbid. Putting a rubber ball in your mouth (or their mouth) and asking for it hard might be illegal in the deep South or down in Texas, but in any other progressive city it is no one's damn business. I mean really, who even WANTS to know. It certainly shouldn't affect a person's ability to drive, unless they're half-bind and the nipple clamps are too tight. Freedom isn't pretty. And what's the greater crime against nature, libertarians? Wild autonomy, or being locked into sterile relationships to please the whims of your church, parents, and community?

I suppose pedophilia is a sexual orientation also... is it acceptable though?

If consenting adults want to smack each other around that's up to them, but there have to be some checks in place to be sure people's 'rights' don't allow them some legal defense when they hurt someone who doesn't want to be a part of their choices.

I do not view BDSM as sexual orientation. But nobody should be denied a driver's license just because they like that kind of thing. That is like saying "we will draft you and send you off to a war you cannot vote for" like they did in Vietnam. And what people do in their private lives is up to them, not the government, politicians, and burocrats.
