Court Shoots Down VPD Attempt To Block Rights Hearing

Title: COURT SHOOTS DOWN VPD ATTEMPT TO BLOCK RIGHTS HEARING
A B.C. Human Rights Tribunal can investigate sexual practices involving "bondage, discipline and submission, sadism and masochism" to determine whether the Vancouver Police Department discriminated against a self-described pagan, the B.C. Court of Appeal says.
For the past two years, the department has wasted our tax money trying to prevent the human rights watchdog from investigating a complaint from Peter Hayes, a Vancouver man refused a chauffeur's permit.
Hayes was upset because he lost a potential limo driver's job when a police officer refused him a chauffeur's permit, seemingly because of his lifestyle.
Hayes said [Officer Kevin] Barker wouldn't give him many details, except to say the concern had to do with paganism, Wiccan magic as well as role-playing, master-slave sexual practices. He was told he posed "an extreme risk of recruiting passengers/customers into my cult during my work hours if I were granted the chauffeur's permit."

Curiouser and curiouser? I would think that the Human Rights Tribunal would want to deal with situations in Darfur, not this.
The man should not be discriminated against due to his religious beliefs, as I personally hate it when people use "cult" as a pejorative. However, like some of the other folks how the cop found out about his sexual practices remains a mystery. Understanding that fact changes the case.
Being into BDSM isn't like being homosexual, which is a significant part of your life, as it constitutes with whom you're going to spend your life romantically. BDSM is a small something you're going to do during that time. It in no way falls under orientation. It should in no way have been an issue. For the cop to know suggests that something is up.
Dude should have gone with religious discrimination (so everyone can start assuming that all Pagans are into BDSM... yay stigma!)
Oh, and this is just a shot in the dark... For the the love of all things shiny, Emerson was right, "Who so ever shall be a man [woman] shall be a nonconformist." However, when you go for a job interview apply a touch of sense to your dressing so one doesn't look like Marilyn Manson or even, Goddess bless him Robert Smith.

Chauffeur qualifications, as near as I can tell from my brother-in-law's tales of his limo business:
-Must have good illegal and prescription drug connections
-Must know location of best cathouses in town, as well as pricing structure for services
-Must have taken at least one stunt-driving or racecar driving course, and be willing to risk your license for stoned clientele
-Must know the location and relative tackiness of every casino on the eastern seaboard
-Must have an extensive CD collection, so as to be able to DJ for clients and their hookers while driving
-Must know locations, relative tackiness, and have personal connections to every nightclub doorman and security guard on the eastern seaboard
I'm sure there are others I don't remember. Probably you should be willing to consider paparazzi worth 100 points, too.

First, even the so called facts that the cops used are wrong. The "cult" this guy supposedly belonged to was actually a book from the Gor series. So unless they can show this guy has flied on a giant bird on another planet.... Really, don't the B.C. Police have internet access? Secondly, it assaults common sense. Most people who have chaffeurs don't want their employees to start engaging with them. If such a conversation happened, it was probably because the client initiated it because he was already into those subjects. So if this guy would harass his customers, his employer would take care of it. It's called being fired. Third, it's none of the police's business. It's not like drug abuse or blindness. Being kinky or a Pagan on your off time in no way interferes with driving a vehicle in a safe manner. And last while BDSM is not an orientation like straight or gay, it is discriminated against. It isn't dangerous or a cult and if we allow people to mess with people's minds over things that aren't any of their business, then where will it end?

that was what they were trying to tell all those who show up on the job wearing kinky black leather, black net stockings, sharp black stillettos and carrying a whip! I feel the man is in his rights to possess a day job regardless of what he does in his bedroom since his private life is supposed to be just that---private! And to deny him a permit because they are afraid he -might- recruit others into his private games is not only ridiculous, but a denial of his rights. As long as he keeps his private affairs in his own place and away from the job, they should allow him to drive.

How do they even know what kind of kinky stuff he's into? Are they spying on him in his bedroom?
Sounds like he's been talking about it in inappropriate places. BDSM is not something people at his job need to know he's into. It is not appropriate to talk about your sex life at work.

The BDSM subculture is really discriminated against regardless of religion. You have the right to do whatever you want in your bedroom without government interference. I think that's why it counts under human rights, sort of like how sodomy laws were declared unconstitutional here.

Maybe I'm misunderstanding the situation in Canada, but what do human rights, and laws protecting certain sexual orientations have to do with it? It is, on its face, simply a case of an arbitrary and capricious decision by a police officer - something which it should be possible to challenge without invoking sexual discrimination and human rights! And why are the police fighting it so hard, I wonder...
