Ontario: Jews, Muslims To Fight For Tribunals

Title: JEWS, MUSLIMS TO FIGHT FOR TRIBUNALS
Jews and Muslims in Ontario are vowing to fight for religous-based tribunals to settle family disputes, just days after Premier Dalton McGuinty stunned them by announcing he would ban all religious arbitration in the province.
McGuinty's announcement on Sunday came after hundreds of demonstrators around the world last week protested a proposal to let Ontario residents use Islamic law for settling family disputes.
"In the case of the rabbinical courts, they have functioned for hundreds of years in Ontario and there have been no issues, no complaints," Frank Dimant, executive vice president of B'nai Brith Canada, said. "And now to merely outlaw them as having any standing before the law, because of internal differences of opinion in the Muslim community, is simply unfair."

It's important to understand that Canada, as a formal country, developed quite differently from the US.
Where the US was a kind of "rebel firstborn child, " who, with a rebel yell, rejected his parent country and "ran away from home" as it were, Canada is the proverbial "middle kid" keeping ties with mom, and just trying to keep everybody happy. "Let's be fair ... "
Canada was at one time split pretty evenly between French and English settlers (apologies for not including Canada's native peoples here, but, let's face it ... they were never considered as part of the bargain, except for a few treaties, which were then promptly broken) , and was eventually ceded to the British by the French after a British win in one of those interminable French/English wars that bored us all to death having to learn about in school.
In an effort (no doubt an entirely self-preserving one) , to keep the French from rebelling and bringing another full scale French/English war to Canada, the new government gave certain rights to the French in re their laws (based on the laws of France) , and their religion: The French, with, probably only a RARE exception, were Roman Catholic. The British were CoE.
This established a "written into the books" promise of freedom for Catholics to practice their religion without interference. And that's how it began.
Another difference between us is that the US is often referred to as a "melting pot, " while Canada is "multicultural." Somebody, somewhere, had some very high ideals, envisioning a kind of United Nations of cultures living here in Canada, in peace and harmony. Unfortunately, IMO, it just really isn't workable when dealing with real, live people.
It's time for this "one law for this group, and another law for that one" to end. There should be ONE law for all, in our justice system.
For anyone who believes that people should always be free to practice their religious and cultural traditions without interference from others, and that it's bigotted to try to stop them ... I leave you with three words: "female genital mutilation." (Now, there's a little "culture" for you.)

Well, the word “voluntary” might appear in the “official” lettering of the Faith Based Tribunal documents… however, how can that be guaranteed?
For example; a woman raised in a berka and told from every source in her life that she is subservient to man, unworthy to walk beside a man, unworthy to serve her God on an equal level with man, suddenly finds herself being ditched so that her husband (who she married at the age of 12) can have a younger, prettier wife. She has no money, little education, and is expected to live in a small room of the house so she can continue taking care of the children. She is, for all intents and purposes, an indentured slave.
Is this the type of woman who would go against her upbringing and entire community by *refusing* to partake in a religiously based tribunal that is already stacked against her – even if she wanted to have a little more freedom for herself?
I would not put money on it.
By banning these types of tribunal farces, Ontario is ensuring the rights and freedoms of ALL people – even those who are unable to speak up for them themselves.
I find it pathetic that Jews and Muslims attempt to steal other people’s rights under the guise of “religion.”
This is not the backwoods of Afghanistan or the streets of Israel. I can walk down the street and see a Mosque and a Synagogue and a Baptist Church and a Chinese temple all on the same block. And why? Because this is CANADA. Everybody has a voice!

What this all boils down to is whether a religious body can claim the inherent authority to (1) deny an individual their legal rights, as dictated under the codified laws of a sovereign State...or to (2) award special rights that are contradictory to to codified laws of that same said State, to an individual. To me, at least, it's a no-brainer

So, are courts supposed to deal with every little affair?
Weddings are a contractural publication, and should include designation of arbitration parties. Such in culture courts would only be manifest before Civil Court, by the testimony of the relevant minister.

I don't see how you can allow religiously-based courts to have legal stading. I understand that both the Jewish and Muslim communities have long legal traditions. If families would like to attempt to resolve problems through mediation, without involving the courts, then of course they could work with their religious leaders to reach some agreement. But when it comes to actual, legally binding agreements, then I would say it has to be through the Justice system of that country.

The only way that the law can be fair for all people is if there is one legal system that all people must abide by. When parallel legal systems are permitted based on religious grounds then there is no guarantee of legal fairness.
The big reason that was reported recently to explain why McGuinty turned down the idea of "religious courts" was that it would put women in particular into vulnerable positions. It's not much of a secret that some religious groups are very discriminatory towards women. Allowing these religious groups, or any religious groups, to act as the legal authorities means sacrificing the rights of women.
