Worker Fired For Wearing Raelian T-Shirts Gets Job Back

Author: Montreal Gazette Source: Canwest News Service

Title: WORKER FIRED FOR WEARING RAELIAN T-SHIRTS GETS JOB BACK
Extraterrestrial believer Jean-Francois Bergeron has his job back at a Granby, Que. factory where he was fired in January for wearing T- shirts from the Raelian movement, which questions the existence of God.
"I'm not surprised, I was expecting that," Bergeron said Monday of the decision handed down last week by Quebec labour tribunal arbitrator Richard Marcheterre - who said the employer's dress code violates the Charter of Rights and Freedoms.
The 51-year-old electrician at Delta Transformers Inc., about 80 kilometres south of Montreal, said the company twice made offers to encourage him to drop his case.

That covers most of the explanation. I am not sure what the electricians in the factory that he worked at in Quebec have to wear, but at the factory that I work at in Alberta I know what they wear. Company logo on Company Fire resistant coveralls. At least when they are in a work area of the factory. If this had happened here I could be fairly certain that it was because of what he was wearing when he was going to or from the locker room, on lunch, or on a break.
PS: On the occasions that a crew that builds the transformers/electrical equipment gets sent out to install it, they wear the company logo safety gear. Except for the times mentioned previously.

I think this is one of those gray areas where the employ was actually in the wrong. I know that if I have an electrition working on my home I expect him to be dressed professionally and not like a missionary for some religion or other.
Here in OZ most larger firms dealing with telecommunications and electrical work have uniforms. The Important thing to note is that on company time he is representing the company. And in this case the company is not in the business of sending out religious messages.
If he is ever sent out to work at a church or other place of worship his choice of shirt might prove to be a significant problem.
Keep in mind that we are not talking about a small unobtrusive symbol of faith we are talking about a large deliberately conspicuous message, which will be viewed as insulting by some people. Some of these people could be clients of the company who are paying to have work done.
On his own time yes, when out representing the company no, its simply not professional behavior.
