Can witchcraft be classified as organized crime? This question by Luederitz Urban constituency councilor, Fluksman Samuehls, provoked considerable laughter in the National Council yesterday.
"Yes, if it can be proved," replied Mines Deputy Minister, Henock ya Kasita, who was making his contribution to the debate on the Prevention of Organized Crime Bill, currently under review in the House.
Ya Kasita said if it could be proved that somebody had bewitched someone, witchcraft could be regarded as an organized crime since it has been claimed some people organized crimes through witchcraft.

We don't cut off everybody's hands just because it is possible to strangle somebody with them . . . punish the crime (if one exists) not the means by which it was committed.
Crimes require intent; the weapon used is not at fault. One of my favorite bumper stickers goes, "Guns are no more responsible for killing people than spoons are for making Rosie O'Donnell fat."
If somebody uses magick to harm someone, it is their intent that caused the crime; the magick didn't jump up and do stuff on its own.
And anyway, have a little faith in karma.

I don't know anything about the Conneticut case, but I've seen some interesting documentaries about native witchcraft in Africa. In some communities, they take it very seriously and practicing it is fairly common... especially in the rural villages.
And let's get this straight, just because no one else brought it up, the offical in the article was most likely speaking of the traditional and ancient practices of tribal Africa (not Wicca) . In most cases it is spiritual healings and divination and the like, but curses hexes and spiritual rape DO occur and turn entire communities upside down until someone comes to cleanse the problem (usualy a banishment ritual and the accused witch apologizing and promising not to do it again) .
The whole thing is a bit silly, but most be looked at in context. If the offical came from one of these villages, he might truly feel that there are people usuing the rituals he saw as a child (or an adult) for corrupt purposes and want to punish them if they are caught.
I say leave it up to the priests or shamans who are spiritually trained to deal with it and out of the government.

This may not seem like a big deal, but assuming this article is true and not satire or parody, this could be very dangerous. Remember that direct proof is not necessary, indirect evidence can be used as well. As an example, suppose Jane had an argument with someone over poor service and later something bad happens to that person, such as a car wreck. Depending on the area, all it would take to convict would be a few people testifying that they heard Jane chanting the night before (which was actually part of celebrating Samhain, for example) and that Jane was known to practice witchcraft. Since there is no forensic method to determine whether or not magick was used to cause the car accident, indirect evidence and inference may be used instead. If it is possible to convict someone of murder without a body or murder weapon, then it is possible to convict someone of harmful witchcraft without direct evidence as well. If the trial took place in a place where superstition or fundamentalism are strong (such as the bible belt) , it is even possible that spectral evidence could be introduced along with the other circumstantial evidence (performing a ritual just before the event) .

You do not have to shoot someone with a gun to use it in a criminal fashion, nor does your abuse of the Craft have to cause objective damage directly in order to be serving time in Connecticut at this moment. I wonder how that lady is making out.

I defy any person to legally prove someone cast a Negative spell that worked on anyone! (heck next "the Devil made me do it" Defense will rise again) But then again some alarmist will scream it is "the Beginning of the Burning Times" all over again.... Well at least there is some recognition of Witchcraft in the Government even if it is feared and thought as being Gang/organized crime related.... Looking for the ray of Humor Rowan
