Alabama Law Offers Less Protection For American Indian Sites

Title: LAW OFFERS LESS PROTECTION FOR AMERICAN INDIAN SITES

In Alabama, American Indian burial sites don't have as much protection as other graves and memorials.

If someone knowingly invades a grave created in the last few hundred years it's a felony. But it isn't if you destroy a far older American Indian burial site on your property, officials with the Alabama Historical Commission say.

Under the current law the City of Oxford didn't have to hire the University of Alabama for a study of a stone mound behind the Oxford Exchange. And the archaeologists who performed the study didn't have to send the study to the Historical Commission for review, a move that highlighted the commission's disagreement with the report's findings.

The mound is estimated to be 1,000 years old and of American Indian construction. It was scheduled for demolition. The dirt underneath would have become fill for a Sam's Club.

So if a person in Alabama finds, on their land, a grave holding a White man (or woman, or child) , they have to leave it alone -- but if it's an American Indian grave site on their land, they have free rein to dig it up and scatter whatever remains are found. That's what the law in question says, basically.

It looks to me like it has more to do with the idea that since they are not of "Christian" origin, the graves/sites are not really worth protecting. Typical White, Anglo-Saxon Protestant, in-bred Plantation "Suth'n" ignorance. (and I do apologize to all truly intelligent people who happen to live in the region - y'all ain't all in-bred ignoramuses, no matter how out-numbered you are)

Here's something for all the folks in "Alabammy" to think on: The Sovereign Nations of the Americas just might decide to enact their own laws, worded and structured along the lines of your own law (s) regarding grave site desecration. Here's a first draft of what i feel the new Reservation law should look like:

"Any person holding Title to any portion of any Reservation, knowingly desecrating an American Indian grave, burial and/or archaeological site on the land they hold Title to, shall be guilty of a felony, but if the grave and/or archaeological site is of non-American Indian origin there is no crime involved in excavating, removing or destroying the site."

Yep, all them Pioneer churches and temples and unmarked graves and battle fields will be open to being destroyed to make room for a BP or TGI Friday -- or another Indian-owned casino. How's that grab y'all, Alabammy?

There are a lot of sarcastic comments that come to mind, but one truth is, the sacred site of one people is about to be buried beneath the sacred temple of another.
If anyone wishes to ponder: what are the great buildings and constructions of earlier people? Temples. Invariably temples to worship and as a demonstration of what is valued.
So: what do North Americans spend most of our resources building?

If Whitewolf went and desecrated a Civil War Cemetary, that could be taken very seriously by the State of Alabama, or the US Government... Was it a Union or a Rebel Site?

Part of the issue, is whether anyone remembers that dead are buried there. Red People have been dying in the area, longer than Red People are going to remember, and might have been Sioux, Mohawk, Pikuni, Seminole, Aztec or others, that the Cherokee People haven't been carefully documenting.

Pre-Columbian, Pre-Templar, even Pre- Brendan, Thor Heyerdahl has been tracking some children of The Sun God, with racial similarities to the red headed Sumerians, that traveled by Reed Ship, and built a distinctive type of Monument, and, if it's over a mere millenium, the style of Masonry might be compared to what he was finding. Those might be White People, other than the lousy Spaniards.

Well, wilfully or knowingly desecrating the graves of those who've died will tend to disturb most human beings, and it won't much matter if the grave is of White Folk, but the laws have to be some how limited, and this is just worded badly. At what point is it Illegal, Immoral, Ungentlemanly, or just bad luck? In this case, the town seems to have the legal right, to desecrate a potential tourist attraction, but seems to have opted for slightly better.

I hope such courtesy doesn't violate any municipal contracts.

I lived there for years till I escaped to an ever-so-slightly-more enlightened neighboring state.

The lawmakers in Alabama have historically not been proactive about the image of the state. They let old, offensive laws languish on the books until enough people start complaining. then and only then do they think about doing anything about it. And by "people" I mean white voters with money to grease the machine. Nobody else counts. At least that's my experience of Alabama 1977-1996.

In Washington State, here's wqhat happened when the wanted to widen the access for the Hood Canal flating bridge.
First they found artifacts. Work was haled and experts summoned. Those experts took a look and said "hey, this is beyond us we need the tribes" The tribes were consulted, more was exposed and they found there was a whole ancient village site where they wanted to put the roadway.
Result: They buried the site, recorded waht they found for future reference and GAVE UP on that construction and redesigned the access to avoid the villiage site.
This wasn't an easy process, but because people took their time and thought about it, it didn't go totally crazy and got resolved.

the uproar that would happen if someone decided to strip mall a southern civil war burial site. Yet some are expected to stand by when their ancestors are dug up and mutilated for the same reason.

If there are bodies at the Oxford site, then building a superstore over it is sacrilege.

Hell, the law itself is pretty disgusting. Just because someone's a Native, they don't have the right to rest in peace? Is that really the message Alabama lawmakers want to send?
