Judge Rejects Request For New Trial For West Memphis 3

Author: Jill Zeman, Associated Press Source: AMNY.com

Title: JUDGE REJECTS REQUEST FOR NEW TRIAL FOR WEST MEMPHIS 3
A judge on Wednesday rejected claims that DNA evidence clears three men convicted of killing three 8-year-old boys in 1993 and denied their requests for a new trial.
Lawyers for Damien Echols, Jason Baldwin and Jessie Misskelley — known to supporters as the "West Memphis Three" — had argued that new DNA tests would prove their clients' innocence.
Both Baldwin and Misskelley claimed their lawyers failed to adequately represent them during trial. Their lawyers said DNA evidence provided by Echols' defense team showed that the men did not kill Steven Branch, Christopher Byers and Michael Moore.

this was supposed to be a nation where the rule of law prevailed. Oh, wait, I forgot that Adolf bush was president! It doesn't surprise me that the WM3 didn't get a new trial; they are in the heart of brain-dead, sister-marrying fundy-country, where a mere allegation of wrongdoing equals guilt. Never mind that a reasonable doubt should bring about a new trial; one of the WM3 is named "Damien". Why should the case be retried when according to the unassailable authority of Hollywood and various mega-preachers, anyone with a "devil-name" MUST be guilty! Give these guys a new trial, for pete's sake! What's the worst thing that could happen? Real Justice????

This type of corruption and miscarriage of justice has happened in every state of this nation. Dozens, perhaps hundreds of Americans have been executed for crimes they did not commit. I am generally in favor of capital punishment, but obviously not when it happens to the innocent. Not when it has on relation to truth or the DNA trail and is merely the work of overzealous prosecutors who withhold evidence and go for the win, no holds barred. It's a horrific problem. And should the DOC should have the right to imprison anybody if they can't control prison gangs, the flow of contraband, or generally protect one inmate from another? I have absolutely no faith in our justice system.

Far be it for me to apologize for Arkansas and some of the stuff that does happen here. But let me say a few things here.
The " backwards hicks' comments are bigoted, folks. I understand the disappointment about this case as I also feel the trio were railroaded and are innocent. HOWEVER my hackles go up when people who don't know what its actually like to LIVE here regurgitate the comments I see here about Arkansas and its residents.
Yes this is a grave injustice and yes the judge's ruling is unfair. But guess what folks. MANY in Arkansas feel as you do about this case. So lay off the " hick" comments.
Part of what this is about is the prosecutor and police not admitting that what they did was wrong. That doesn't just happen in Arkansas. Then there's the problem of those in power not wanting to share responsibility and blame. If any of you actually studied the case you can see the various parties I am talking about.
Was Boss Tweed and Tammary Hall from Arkansas? Nope. Corruption doesn't happen in one state.
And let's be honest here. The bands that appeared supporting the WM3 were of a particular style, a style that to mainstream eyes may have hurt the cause.
Yes the judge's ruling was a setback. That's what appeals are for. Regional bigotry isn't increasing the support needed for this.
We of all people should know what harm such stereotypes do. The Civil Rights marchers didn't win by sneering at the racism and calling every white person in the South names. They won by showing they were BETTER people than the racists.
Knock it off.

I believe that they're innocent.
I also believe that every single adult in the state of Arkansas, myself not excepted, will have a karmic price to pay for this.
I also believe that this sick miscarriage of justice has less to do with religion, and more to do with the desire to appear to be right. They railroaded the first suspects they could get their hands on because the did not want to admit to being unsure or confused; they will not allow them to be retried because they do not want to admit, especially amidst very sharp criticism, that they very probably made a serious mistake.
"Burn the witch!!" and "Cover my ass!!" look a lot alike. In fact, I tend to be of the opinion that a lot of witch burnings are, in effect, ass-covery in action.
Human nature is really, really sick.
On behalf of the State of Arkansas, I'm really, really sorry.

The judge was never going to let them free, even though they've obviously never done it. Hillbilly justice at it's best.

And the crowd falls silent as the obvious situation comes to pass.
Seriously, those fundie hicks won't change their minds about framing three innocent people.
