Title: COURT: CUSTODY RULING NOT BASED ON MOM'S RELIGION
A Chicot County judge did not base his decision granting custody of a 2-year-old boy to his father on the mother's statements that she practiced Wicca, a sharply divided court of appeals ruled Wednesday.
The Arkansas Court of Appeals upheld Judge Robert Vittitow's ruling awarding custody of the boy to his father, Joshua Cook, and rejected Andrea Hicks' claims that the decision was based on religious preference.
Judges Sarah Heffley and Josephine Linker Hart both dissented and said they believed Vittitow's comments about Wicca showed he based his decision at least in part on Hicks' religion.

...I'd say there was something improper going on.
Dirty fingernails-- even very dirty fingernails-- can happen in no time flat, and even a good parent can get sick and tired of holding the little darling down to scrub them clean every evening and decide to let the dirt go for a while.
I, personally, keep my kids' nails cut back as far as possible without risking them becoming ingrown. They hate twice-weekly nail clippings, but it means the dirt always comes off in the course of washing their hands.
Again, even children with doting parents get diaper rashes. Sometimes severe diaper rashes, that can take weeks to effectively treat. I've been extremely fortunate that neither of the pediatricians my kids have been through had a bias, an agenda, or unrealistic ideals about parenthood, as my daughter had for her first three years very sensitive skin resulting in raw patches if I failed to change her quite literally as she was still moving her bowels. My son inherited his mother's predisposition toward Candida, and is at this moment covered in an ugly, red, scaly rash resulting from a 14-day course of amoxicillin. This is his fourth Candida infection (and eighth ear infection) in his so far very short life, probiotic yogurt and frequent extended nudity notwithstanding.
Goddess bless the Catholic pediatrician who, instead of criticizing me and putting in a call to DHHS, tells me stories of her two younger sons and suggests I replace zinc oxide with myconazole during the course of and for 10 days following antibiotic treatment.
Is it religious discrimination?? The original judge's frequent and excessive mention (any mention should be considered excessive) of the mother's religion also leads me to believe so, though that may not necessarily be the case.
It's equally possible that the judge is a raving misogynist, as was the judge in our home county in WV who awarded sole custody of a five-year-old child to an untreated, unmedicated, uncontrolled manic-depressive known crackhead father on the grounds that the mother, who had sought treatment for manic depression and substance abuse, was obviously unfit to parent.
It's also equally possible, especially in a place as small as Chicot, that it was another g*dd*mn good ol' boys situation. Which has nothing to do with religion, or with bigotry, or with anything other than making sure your friends get what they want, not because they are right, not because they are good, not because they are "Godly," and not out of any hate for the outsider, but simply because they are the friends of one party in the case.
As, in the above situation, the judge in question happened to drink beer and smoke pot with Crackhead Daddy's mother on a monthly basis.
Again, my folks wonder why I didn't divorce the psychotically insecure sicko I was fool enough to marry. Self-respect, my foot. I stayed out of self-defense, not a lack of self-respect. Could the fact that I was watching my friend go through this while living on our couch (the fact that the judge's order that she pay alimony, child support, and the mortgage on their house, coupled with the extortion in alcohol her ex-husband forced her to pay if she wanted visitation, left her with about $60 a month to her name) have anything to do with it?!?!?!
Self-respect drove me to rather ruthlessly browbeat him into getting some help and cleaning up his act. I won't say we're happy, or that I'll ever love or trust him unreservedly again. What we have is more detente, a fragile and uneasy truce that will either heal with time or end in a mutually long-awaited divorce when our last child finishes high school. But I will say that he hasn't raised a hand to me, tried to prevent me from going back to see family and friends, or prevented me from taking an hour to myself, away from the house, without a d*mn good reason in over a year.
Again: YOUNG PEOPLE, WATCH YOUR BACKS. IF YOU HAVE ANY DOUBTS ABOUT YOUR PARTNER, DON'T GET MARRIED. Talk it out, get couples counseling, use my story as a cautionary icebreaker. I'd further advise keeping your pants on and your knees together-- kids in that situation can be a pain, and sex really does shoot most people's objectivity all to Hell-- but if you're not willing to do that, DO NOT GET MARRIED.

I think we need a bit more info on this case. Anyone have more links?? Are court files available? Seems to me this may be a "Witch-hunt", or simply a bad parent. JMO

is aparently what the judges did here. I'm not convinced that the other factors mentioned in the article were enough to remove the child from the mother's custody.
