Judge Dismisses Challenge To Ariz. School Tax Credit

Title: JUDGE DISMISSES CHALLENGE TO ARIZ. SCHOOL TAX CREDIT
A judge on Wednesday dismissed a lawsuit challenging the constitutionality of a new law that created a tax break for business donations for private school tuition grants.
Judge Janet Barton of Maricopa County Superior Court ruled two days after hearing arguments on motions by the state and the tax break's supporters to dismiss the lawsuit. It was filed Sept. 19 by the American Civil Liberties Union and the Arizona School Boards Association.
Supporters say the tax credit, which would provide dollar-for-dollar tax breaks for businesses' donations totaling $10 million, will enable more parents to send their children to the schools of their choice.
Critics contend the tax credit diverts money from the public school system.

The court clearly decided this case superficially, which is common, when treacherous subversives find tactical frauds by which to mask the reality of their intent and effect.
Arizona politics are distorted by a strange mix of RRR-GOP (who do well undercutting business oriented GOP leaders, like one nudist resort owner there) , and libertarians who often are remiss in countering abuses of power by RRR factions. If one follows the links below this article, one of them traces to Len Munsil and other operatives for legal tactical Dominionist organizations intent on undercutting civil rights not just in state, but nationally. That's also reflected in who and how this suit was defended.
Regardless of this court decision, the clear intent and effect of this tax law is to favor and enable RRR indoctrination of kids. The court win doesn't mean that either the intent or effect of this law are Constitutional, but merely that dangerous Dominionist predators won a technical round of finding a court which bought their fraud. A closer look will reveal it's knowing, malicious fraud intended to cater to quirks of legal process, not just incidentally, but by clear strategic design intended to violate the core legal standards for law.
Sometimes courts put procedural due process, playing sick lawyering games resulting in decisions the reverse of the underlying law, ahead of substantive due process, or using legal process to render a just and Constitutionally valid result. When courts do that too often, they become so broken as to invite treating judges like "domestic enemies" along with corrupt politicians, and considering what revolutionay reforms are needed to restore honest justice and equity.

School choice issues usually get my curious so I checked out the Arizona School Board website, www.azsba.org. I saw a few distrubing articles, like the about their fight against teacher accountiblity, homeschooling and how evil rightwingers are out to undermind education in Arizona and across the country. I'm not a fan of rightwing orinented education, but if someone wants their children to be educated that way I won't stop them.
