Psychic Wins Battle With Gilbert Over Permit

Title: PSYCHIC WINS BATTLE WITH GILBERT OVER PERMIT
A Gilbert psychic has challenged the town's license and permit fees and won.
Paula Parris said the requirements to get a license and permit as a fortune teller in Gilbert were "excessive," costing her $1,300 more than most other businesses.
The Town Council agreed, and removed the fortune teller fees and authorized staff to reimburse Parris and anyone else charged in 2009.
Three Gilbert businesses have licenses as fortune tellers: Déjà Vu Psychic, Santan Village Psychic and Parris' Gilbert Psychic Consultant.

Anyone who understands the history and intent of this style of "Sexually Oriented Business" laws would see how this outcome may be pragmatic for those who've benefited, but is a far from ideal outcome. In fact, it's the lazy way out, rather than head on challenge a law that is by effect and intent entirely unConstitutional and should never exist.
The ordinance in question comes from a model developed by National Family Legal Foundation, formerly of Scottsdale, AZ, before a family feud of rabid fundies that resulted in its split into what are now Community Defense Counsel and Alliance Defense Fund, also of Scottsdale, but active nationally. This law is intended to end run around the Constitution, by "regulating" protected speech and activities in ways designed to make it difficult to operate businesses rabid fundies dislike. The usual suspects, like Wildmon, Dobson, and their ilk, financially back and promote the activities of NFLF, ADF, and CDC, which did and do function as behind the scenes political and legal tactical operations.
Their tactics are based on a 1981 Indiana theater prosecution that's based on fraudulently distorted financial evidence that what rabid fundies broadly define as "sexually oriented businesses", including extremely broad traits so as to not appear to be singling out religious dogma based targets as their real intent, that allegedly harm communities, and therefore justify pretending extreme regulatory limits on them are about money and values of property, and "community morals", and not about religious bigotry based intent to squash rights to be free of such biased law, despite that clearly being their published tactical goal. The conditions of this case, exorbitant licensing fees, invasive personal information demands, restrictive zoning access to few if any viable business locations, limits on similar businesses near each other or many other classes of land use, etc, are designed to come as close to an easy to overturn outright ban on protected activities as possible while facially using the fraudulent guise of neutral and justifiable regulation. In a few cases, the distorted and misrepresented economic effects data the Rehnquist court endorsed, with Suitor the lone member to flat out call it what it is in Erie v Pap's, pieces of that style of law have been overturned or completely eradicated. RRR operatives have focused on passing thousands of these local ordinances, and training thousands of prosecutors to maliciously enforce them, because it's easier to sneak illegal laws through local governments than to pass the review and challenges found at state and national levels.
Therefore, pagan businesses DO belong classified as this one was under such laws, along with nudist resorts, therapeutic medical massage businesses, university, arts, industrial education, and children's or museum cinemas (any that show X or unrated movies) , etc. The effect of such ordinances is designed to reflect psychotic delusions of rabid fundies to squash a range of civil rights, and so they're not intended in any way to be anything but an oppressive circumvention of Constitutional limits, packaged to be tricky to overturn.
While this may be the easy way out for Ms. Parris, it's ultimately a bad solution. She had standing to sue for complete overturn of the ordinance, and likely could have found help at the ACLU, AU, FFRF, etc. ADF (the RRR legal thugs, not the Druids) likely would have offered to supply the town with a lawyer. An honest court would have to overturn the law, but there are lots of lazy and dishonest courts, and it's tricky to develop the legal evidence needed for this kind of case. That's part of the tactical, malicious design of these ordinances, all rooted in the same series of what are rightfully criminal conspirator RRR groups and local politicians, working on as big a clusterfvck as they can manage.
The real headline? Local business owner weasels out on doing what's really needed in the community, for personal benefit.
