ACLU Asks Florida Court To Protect The Rights Of Pregnant Women

Title: ACLU ASKS FLORIDA COURT TO PROTECT THE RIGHTS OF PREGNANT WOMEN

The American Civil Liberties Union and the ACLU of Florida today filed a friend-of-the-court brief opposing the state’s decision to force a pregnant woman to remain hospitalized against her will.

In March 2009, the Circuit Court of Leon County ordered Samantha Burton – a mother of two suffering from pregnancy complications – to be indefinitely confined to Tallahassee Memorial Hospital and forced to undergo any and all medical treatments deemed necessary to save her fetus. After three days of state-compelled hospitalization, Ms. Burton suffered fetal demise and was released from the hospital.

that the anti-abortionists i.e., the fundys, constantly rail against big government, yet when THEY have the government's ear, they happily toss their so-called principles in the trash can and do the very thing they SAY they are against.
This is one of many examples of xian fundy hypocrisy; they insist on religious freedom (for themselves) and then FORCE their beliefs on this woman, illegally imprisoning her and potentially endangering her life, just so a FETUS, not a PERSON yet, just a fetus, might possibly get through the complications, and not be born dead as was probably inevitable anyway.
The action on the part of the State of Florida is CLEARLY impermissible under the First Amendment as an admixture of church and state. I hope she takes Florida to the proverbial cleaners!
Matters like this force me to HATE xian fundamentalism.
When are the SMART people going to go on the offensive, get organized and shout down these inbred fanatical bozos??!!

that's what this is. Women are more than their fetus when they're pregnant. People seem to forget about the other brain in an expectant mother's body... hers. Unless sh is suffering from a mental disability or is ruled criminaly insane, etc a pregnant woman is as mentally sound as the next guy. So why is she incapable of making her own medical decisions?

After all the imposed bed rest, they do a C-Section and send her home!! Where is the recovery time for that?? Now that she has had surgery she can clear out and go back to taking care of kids at home and whatever? This goes way beyond holding her against her will -- there has to be some kind of criminal liability here, and the ACLU should be looking at more charges.

Roe v. Wade gave woman the right to do what they please with their fetuses. Period. End of story. Just because you don't like it, doesn't mean you have the right to brutally force your ideas upon her.

I'm not a huge fan of abortion either, but I wouldn't force someone to die just so that the twins would survive. For all we know, she could have had another, less dangerous pregnancy in the future if she had had the abortion that would have allowed her to live. We can't know that now because she's dead.

Thank, you, Florida, for sacrificing a woman's life on the altar of the pro-life agenda. You're not making me proud to live here.

Any doctors or hospital staff and corporate entities involved in this egregious bible thumper conspiracy deserve to be bankrupted and lose insurance with malpractice actual and punitive damages, plus lose facility and personal licenses for not just easy to do accidental or clueless violations of medical ethics to treat patients in their own religious frameworks, but malicious and willful conspiracy to violate this patient's rights.

As to the court, judges and other court officers deserve similar treatment were the law not badly broken to treat them like some archaic king's men. That only leav es impeachment, unlikely in a RRR infested legislature, or 2nd Amendment redress against domestic enemies, when the courts tasked with preventing this kind of abortion of civil rights instead conspire in same.

Unfortunately, the ACLU's both good and weak point is that they're infested with law seminary grads. They're unwilling to seek justice, when that means remedies unlikely to be available from corrupt courts and judges.

"Welcome to the Evening News. Tonight's top story: Dead woman gives birth.

A Tallahassee woman was forcibly hospitalized two weeks ago, as a measure to ensure that her unborn fetus might survive despite the documented knowledge that the expectant mother would be completely unable to survive carrying the fetus full-term. As expected, the mother did indeed die. The fetus was delivered yesterday by C-section, even though the mother had been medically dead for the last five days. The birth is being hailed as yet another clear indication that the new Florida law requiring that all fetuses be carried to full-term is the right way to go.

In a related story, a Tallahassee man was arrested today after he entered the local Justice building, brandishing an automatic rifle. He somehow was able to enter the corridors outside the courtrooms, calling for "that f****** judge" to come out so he could show the judge some "true justice". Details concerning the man are a bit sketchy at this time, but it appears he is the husband of the woman in tonight's top story.........."

Face it: thanks to eight years of tyrannical Republican rule, this is the gift from hell that will keep on giving. Do not expect Obama to save you from it--he does not believe in being openly aggressive or even to risk controversy. His moderate tone alone is too controversial for these raging theocrats. It is clear as day we are not living in a developed nation anymore, since we are lagging behind Europe and Asia in almost every possible way. We don't even hold clear title anymore--China does, and they are strong. Nor could any sane person consider this a developing nation, in this stagnant, regressive state. This is a decaying empire, and unfortunately women will first and most poignantly feel the worst setbacks. Do I sound hysterical? I really don't think so. Conservatives and Republicans comprise about a third of this nation, and yet Bush passed muster TWICE in the general elections. Yes, I know he was selected the first time, but it was very close. What sort of drugs did it take to make him viable, to make it even close, at any time? Sour grapes from the past, still bearing poisonous fruit. Too little, too late, fellow citizens.

Women are more than baby bags. Fetuses are part of someone else's body until they emerge from it, one way or another. After they're born, they're children. Then their rights kick in. This fetus didn't make it, hospital or not. So someone was medically imprisoned, to not save a dead baby. Go Florida.

How can these people expect a woman with two kids to care for and bills to pay to be on 100% bedrest. It isn't practible. These doctors, judges, hospital staff, and others involved obviously didn't care who was caring for her other children while she was imprisoned in the hospital or whether or not this action would cause her to lose her job, her house, her car, etc.. None of this mattered to them.
I personnaly feel that these doctors, judges and the hospital should be charged with kidnapping, unlawful imprisonment, and assault resulting in serious bodily injury (i.e. the c-section) . The fact that they got a court to back them does not make a difference.
If it were me, I would also refuse to pay any of the bills. If it is court ordered, you are a ward of the state and it's their responsiblility to pay, not mine. I also wouldn't have "asked" to be discharged......I would have left AMA. Until the court signs those papers, the hospital cannot legally force a competent person to stay.

It wasn't even an editorial, but a press release, and I wish the press were more honest on the matter.

For the purposes of the ACLU, the trimester was unimportant. First Trimester could have been aborted, under the abomination of Roe v Wade, and last trimester could have been delivered prematurely, but the woman likely wanted to be home with her existing kids, and her court ordered kidnapping had some moral costs and benefits, when considering those.

When the courts make such decisions, have they testimony from others than of the brotherhood of the kidnappers involved? Psychiatry, fo the 1970s, had entirely too much power, over whether a person was considered sane. Anyone with authority would have had to be crazy, to consider Psychiatry to be a threat to our freedoms, and would likely require forced sterylization.

Buck v Bell was overturned in 1989, despite being rejected as precedent in the Nueremburg Trials, and it was the last year of the Carter Administration, that the insane gained the right to refuse experimental torture/treatments, and so closed the madhouses, sticking Reagan with the Homeless Problem.

Florida is the place to go, for Medicine, with so many retired physicians, but courts across the land are obligated to return arbitrary verdicts.
