Update: Judge Says School Must Let 'Teddy Bear' Students Return

Author: AP Source: ABC News (US)

Title: JUDGE: LET 'TEDDY BEAR' STUDENTS RETURN
Making a movie in which evil teddy bears attack a teacher got two budding filmmakers expelled from their high school, but a federal judge says it was the school that was wrong.
However, the judge said the boys should apologize.
Cody Overbay and Isaac Imel, both sophomores, must be allowed to return to Knightstown High School for the second semester, U.S. District Judge Sarah Evans Barker said Friday in Indianapolis in granting a preliminary injunction. She also ordered the school to allow the students to make up any work they had missed since their expulsions in October.
The boys worked on the movie "The Teddy Bear Master" from fall 2005 through summer 2006. It depicts a "teddy bear master" ordering stuffed animals to kill a teacher who had embarrassed him, but students battle the toy beasts, according to documents filed in court.
The American Civil Liberties Union of Indiana sued on behalf of the two teenagers last month arguing that school officials overreacted to a film parody and violated their First Amendment rights.

The juge is right that that the students have the right to free expression and is that includes films in poor taste fine. The difference here is that a SPECIFIC teacher was shown being attacked, not just a generic teacher character. If I was the teacher in the film I would feel violated. He or She has been slandered, and maybe even threatened (I'd need to see the movie to judge) .
Unless this is a real case of threats kicking them out was a violation of their rights but they need to pay for what they did. Community service would seem to be in order.

"However, the judge said the boys should apologize."
...And and and what will these boys be apologizing for exactly...hypothetically depicting a fictional story line using teddy bears with extreme prejudice...?! I think maybe the adults should apologize for not using common sense...

A kid coming to school with a gun? possible threat. Teddy Bears doing the same? Bad silly nightmare- but a threat? no. There's far worse on the eleven o'clock news. And worse ways to waste film.

this was NOT the first time a few teenagers made a film/story/play/puppet theatre with a horror/hate school theme. It is not the first time some kids used media to show their dislike for teachers/fellow students/employees of the school. It is not the first time someone's name matched the one used in the story, nor was it the first time someone used someone elses name for such a project. (funny., there was a time when it was considered a compliment to have your name used in popular media) . It was not the first time for any of it. Nor was Columbine the first time two kids murdered/injured/rampaged. I love how some people are so programmed by the media as to think any of this is 'new'. (Google 'The Durham Boy' and tell me what you find) .
As an actor/writer/director, of course I side with the boys, because they are products of their societal location, just as any child would be. But, as for this hoopla, I would have thought better of the adults. But, maybe I am assuming too much. After all, we have one of the biggest teen rebels in the white house...why should anyone be more mature than that?

I can see how it might interfere with School Operations, if a Math Teacher finds a threat in your Inhalation, but how was this movie unlawful? The outside activity had to be both unlawful and threatening.
The students should appologize for spelling the twit's name correctly.
