1st Circuit Strikes Down Parts Of Maine City's Parade-Permit Law

Title: 1ST CIRCUIT STRIKES DOWN PARTS OF MAINE CITY'S PARADE-PERMIT LAW
Parts of a parade-permit ordinance in Augusta, Maine, are unconstitutional, the 1st U.S. Circuit Court of Appeals has ruled.
The case arose from an attempt to organize a "March for Truth" parade in 2004 in opposition to the war in Iraq. After calculating the costs for traffic control, the city police department charged march organizer Timothy Sullivan $1,500 for a permit.
Sullivan, of Castine, Maine, claimed the fee was excessive and was joined in his suit by Larry Dansinger of Monroe, who said the city's permit fee of nearly $2,000 prevented him from holding a workers' rights march in Augusta.
A federal judge in Bangor ruled that the fee, the 30-day advance notice and mandatory meeting with the police chief were all unconstitutional.

It is still legal for local municipalities to require permits for PLANNED protests -- they do not, in any real way, restrict anyone from "peaceably assembling" after all, they simply make sure that the group planning the protest actually has a good reason to plan the protest. Please note the word PLANNED. A planned protest is far different from one which is spur-of-the-moment spontaneous.
As for the WBC (Westboro Baptist "Church") , they can "protest' anywhere they want, even in my town -- and we'll be sure to make them feel right at home...right before we send a whole lot of anonymous raw eggs their way! Hmm...raw eggs, kept warm until the "moment of truth", in the dead of winter -- not so easy to clean up as you might think. :-)
By the way -- why would conservative groups now get a discount at California universities? Are they somehow more "special" than other groups?

Did this judge just say that the West Baptist Church can parade in front of any funeral as long as they stay on the sidewalk? No permit/ police control needed? HMM. What if they show up in front of our local church- we have no sidewalks. Two-bit town in Kansas, pop.42

is you - and me. If there is a demonstration or parade that requires police activity to control traffic and shut off streets someone has to pay them. Either the parade organizer pays them or we do. The only money the government has to spend is ours. Asking those who want to use city services for their own private purpose to pay the "reasonable" cost of those services is ok by me. It should be possible, however, to demonstrate that the crowd control and street closures are taken care of by private security or volunteer security and not pay for services you are not using. A meeting with the police department is a good way to show that you are prepared to handle your own parade from a security/crowd control standpoint. I think the permit concept - overall - is not a bad one as long as the cost is reasonable based on actual services used.
