Maine Rabbi Wins Home Worship Appeal

Author: AP Source: Boston Globe (MA)

Title: MAINE RABBI WINS HOME WORSHIP APPEAL
A Portland rabbi can continue to hold prayer services at his home now that the city has reversed its order that barred the weekly meetings on grounds that they ran afoul of zoning regulations.
By a 5-0 vote, the Zoning Board of Appeals late Thursday agreed to allow Rabbi Moshe Wilansky to host Saturday worship sessions that drew complaints from a neighbor over parking issues.
The vote followed a demonstration on the steps of City Hall and pleas by the orthodox rabbi's supporters. Some expressed fear that the city's interpretation of what constitutes a "place of worship" could have put home-based prayer groups at risk.

"By a 5-0 vote, the Zoning Board of Appeals late Thursday agreed to allow Rabbi Moshe Wilansky to host Saturday worship sessions that drew complaints from a neighbor over parking issues."
What they really need, is a prohibition against parking, without the consent of the property owner at that portion of the street. A requirement of 8,000 square meters is too much, for an assembly of eight family members, and entirely too little, for an attendance of 8,000 people.
Is there someone up there, with just two acres, who could perform a blessing of the classic cars?

Cause if the zoning boards original decision was upheld it would affect a myriad of faiths; many Christians who meet at private homes, a Wiccan covenstead, et al.. Besides, if we believe in separation of church and state then the local government has no right to place any restrictions on what constitutes a place of worship.

... I'm thinking that representatives of the Christian "house church" movement felt that this might cramp their own practice of the very same kind of in-home worship meetings, and that the Zoning board might become too "color blind" to "properly" only restrict the Jews and other non-Christians from the practice.
Doesn't the fact that the Rabbi's been holding these meetings there for 20-odd years already create an easement of sorts?
