Title: MINISTER WINS RIGHT TO THREATEN JUDGE WITH BIBLICAL CURSES
A Michigan appeals court on Tuesday overturned a ruling that had sent a minister to jail for threatening a judge with curses from the Bible.
The appeals court unanimously decided the Rev. Edward Pinkney's rights to free speech were violated when he was sentenced to jail for writing a commentary criticizing his trial judge.

The whole idea that a Christian minister putting " curses" on a judge or anyone else make me want to chuckle. So WE are supposedly so bad when we do magick or rituals but this guy is a " servant of god"? What hypocrisy!
Let the little twerp " curse" people. Heck, let him ANNOUNCE whom he's " cursing". Every time some Xian goes off their deep end and pronounces something a " curse" or " abomination", they discredit their faith, demean their gods, and drive people away from their religion.
Not to mention they suck at curses.
Isn't here a verse in the Bible that talks about blessing those that curse you?
The guy's an idiot.

This case makes me think of a hypothetical case that is scary. If Sotomayor is confirmed to the Supreme Court, as seems likely, six of the nine justices will be Catholic, which seems very unbalanced. Now suppose that a case is accepted that would revisit Roe vs. Wade and that the Catholic Bishops threatened to excommunicate any justice who didn't vote to overturn that landmark case. Would this be practicing religious freedom or would it be intimidating judges? An argument could be made both ways, and it isn't a small matter
This isn't a far-fetched case. Former Kansas governor Kathleen Sebelius is Catholic and openly pro-choice. The archbishop here in Kansas City KS has publicly criticized her for this and said that she should refrain from receiving communion, though he hasn't gone so far as to threaten excommunication.
This possibility is worth thinking about.

I'm glad to see a court uphold an idiot's right to be an idiot.
After all-- If they can't put their stupidity out there for all to see, we'll have to work that much harder to know them when we see them. ;-)
Seriously. Silencing a curse, just like silencing an idiot or silencing dissent, will not make it go away. These are things that have to be dealt with-- however annoying, uncomfortable, or stupidly amusing it may be-- to keep a society healthy and growing.
A healthy, growing society may not be something we all think we want. But the alternative frankly puts me off my breakfast.

though like a case of very serious ingratitude. While this preacher has the right to write his objections, and his curses, the fact that he should curse the hand that gave him probation instead of a prison sentence marks what a serious hypocrite he is. As for the judge, I doubt the next time this preacher shows up in his court room as a defendant, that he will be as leinient and might just grant him a legal curse or two of his own as a return favor.

While making a big noise often is a way to get the ball rolling, the quality and clarity of the noise matters. Functional ethics, virtues and laws matter. Correct and most effective venues matter. Clarity matters. Being able to navigate tangles of issues in a methodical way with clarity matters.
The histrionics of voter fraud, mixing issues, threat of divine curses, lack of fact checking...not good form for civil rights movements or any other.
There are important lessons here that have incredible carryover.

I'm glad the issues of the voter fraud conviction and the later religious free speech were kept separate and ACLU cared to make the distinction.
Religious civil rights, 1. Power to the people in times of fallout from accelerating vampiric corporatism, -20. Something like that. It was more than just the Rev. who shot himself in the foot while trying to gain momentum.

"Pinkney’s case has gained the attention of the ACLU, religious and social justice groups throughout the country who feel his treatment and sentencing of 3 to 10 years, is not only excessive, but it is also a gross violation of the minister’s religious and civil rights."
Pinkney wasn't sentenced 3 to 10 for threatening a Judge, but his probation was revoked, for publicly challenging his probation.
Actually, he could refuse Probation, as a way of challenging his original sentence, and demanding emancipation; he'd be able to preach, in Jail, and those beds are expensive.
He's having some problems with unequal treatment, ethnic abuse, and every crime is a relationship, involving a victim. I think this could be handled, if anyone could restore the devine authority, by which he afflicts himself. A Saint, of my acquaintance, wrote a vignette, The Angel That Troubled The Water, and I think an attendance unto such Physicians might hold some respite.

I have yet to find one source of news that isn't biased. (it's always somewhat biased, but this case has strong lines drawn)
I notice the hypocrisy of the Rev as his threat is suddenly hollow. It likely wasn't an empty threat when he said it. Wuss. Martyr!
And I'll be damned if they never ever say whether the threat was made in court or in the paper. Root for the underdog if you like, people, but omitting vital truths is deception.
Criticizing the judge in the paper is his right. If he threatened him in court after getting his sentence, that's another matter entirely. The fact that it is omitted from all available info stinks and makes me think he was attacking the judge in court. I'd like to see the supreme court chew on this one for a while. It's time to ask whether religious threats are hate speech or if they're just blather. I know it would bleed into all types of religious speech, but would it be so hard to keep it to ourselves? It would encompass the "I'll pray for you" comments and the "Jesus died for your sins" one too. As cruel and un-free it may sound, I wouldn't mind if people kept their faith in their own homes. Imagine how many fights could be avoided if folks just kept it in their pants.
Since they cant, I support of a new translation of the law.

As much as I dislike the guy's methods and liken the threat of imprecatory prayer to threat of black magic, the more you read his blog and the links given, regarding what's happening in Michigan, the more fascinating the whole tangle of issues becomes. Michigan is a prime example of corporatism run amok; American, take note.
Note: "The ACLU of Michigan represented Rev. Edward Pinkney’s first amendment claims; however, the organization was not involved in the underlying voter fraud conviction, which was upheld today. Due to this conviction, Rev. Pinkney’s probation will be reinstated."
So, he's partially wrong and partially right and definitely on fire and going in the right direction even while going down the wrong path, mucking up his record, credibility, and logic along the way.
And I say that with great dislike for voter fraud and mixing religion and politics in the manner he did.
