Muslim Woman To File Suit Against Judge Who Ordered Head Scarf Removed

Title: MUSLIM WOMAN TO FILE SUIT AGAINST WAYNE COUNTY JUDGE WHO ORDERED HEAD SCARF REMOVED

Raneen Albaghdady will sue a Wayne County judge who ordered her to remove her head scarf during a routine name-change application.

The Michigan Chapter of the Council on American-Islamic Relations (CAIR-MI) will join her in the lawsuit against judge J. William Callahan to be filed today.

In a partial video of the hearing posted to YouTube, Judge Callahan can be heard saying, "Okay. The head piece? No hats allowed in the court room."

According to CAIR-MI, Albaghdady felt "so intimidated by the judge's repeated demand that she eventually removed her headscarf."

In a multicultural place such as the USA, the laws of the land MUST come before the laws of your religion. Otherwise, we'd have abortion clinic bombings every day. EVERYONE takes their headcoverings off in a courtroom, and just because you're Muslim (or a nun, or a Sikh, or even the POPE) , doesn't mean you get a special exclusion from the law.

I'm rather astonished at both the judge's actions and the responses I'm seeing here.

In regards to the judge, it's pretty obvious that he's not really all THAT sensitive to other religions, otherwise he would/should have been aware that Muslim women wear hijabs (and would have at least called it a scarf and not a "hat") . He was also a bit of a jerk, since he didn't even really give her or her council the opportunity to explain, he just kept repeating "no hats in the courtroom."

As for the responses on here, it doesn't matter whether anyone else considers a hijab of that style to be "progressive" or not (as an aside, that style is actually standard practice, the more covering styles are usually actually determined by the laws of the country they grew up in) , it's still part of her religion and neither she nor anyone else should be disrespected by being told that it doesn't really "qualify" as a religious thing because it doesn't meet some arbitrary standard.

It would be like someone saying a person isn't "Wiccan enough" because their pentacle necklace isn't big enough or is made of pewter and not silver.

Finally, wearing a hijab is not typically a matter of being ashamed. It's often as much a mark of pride as a Wiccan wearing a pentacle.

Perhaps this judge, and others (including those that have commented here) should learn more about Islam in its own right, before they start saying anything about its follower?

In her defence, she's probably been trained to do whatever the most powerful man in the room tells her to do.

If it was just a 'do rag' it may be different, but this was clearly intended to cover her hair and her neck, so yeah, I'd say it was a cultural/religious thing.

What a knucklehead judge.

I see CAIR is at it again.
Notice how they cut the video right before she says it is not problem and takes it off without claiming a religious exemption.
You can also see that is was not even a real hijab, Just a scarf over her head showing hair is hardly considered a hijab by any but the most progressive Muslims and THEY would not have a problem with removing it for two minutes in court.
