State Drops Case Against Massage Therapist

Title: STATE DROPS CASE AGAINST MASSAGE THERAPIST

For more than two years, the Minnesota Department of Health has pursued massage therapist LaRae Lundeen Fjellman for violating state law by having a sexual relationship with a former client, a man she eventually married.

State investigators interrogated Fjellman, made her take a personality test and, even though state psychologists agreed she was "normal" and didn't pose a threat, moved to take away her ability to practice and imposed a fine.

Now, days before the American Civil Liberties Union in Minnesota was set to appeal, the state has changed its mind, saying that the facts of the case "clearly do not constitute the egregious mischief or exploitation that the Legislature sought to protect the public from."

Under state law, massage therapists aren't allowed to have a sexual relationship with clients for two years, even if they marry the client. The law is one of the strictest in the country.

It looks pretty clear why this malicious persecution was dropped. The state has imposed as much abuse as it can, without serious risk of being required to reimburse their victims at least to the extent of prevailing party legal fees. Hopefully the good folks from the ACLU can find some grounds to recover those anyway, as civil damages for malicious prosecution or other civil rights violations.

Rightfully, the entire conspiracy to impose Calvinist bigotry via defective laws is a form of violent crime, as all action backed by government guns to deprive citizens of our rights. Most speech censorship, nudity, sex, and drug restrictions are such violations to favor select bigotry and deprive others of civil rights. Strict enforcement would call for placing all police, legislators, prosecutors, bureaucrats, and judges in such conspiracies in jail as violent felons, albeit that would require one fundamental change to eliminate the silly and archaic practice of pretending such government actors are still some King's men entitled to sovereign immunity to act above and outside the law.

It's Sex as Massage that causes trouble for the legitimate Massage Therapists. It's an advertising deception resulting from a prohibition of advertising Adult Conspiracy Services where a child can see.

What would it cost, to train these attractive imports, drop-outs and College Grads, as Para-Legals, so they can work in Para-Legal Massage Parlors?

The artical doesn't make clear, whether Marriage is specifically prohibited, in the Sexual Prohibition, or if it's simply not considered as a possible exemption. For Liscensed Massage Parlors, you need only prohibit consent to extramarital sex on the premisis, (sp?) so the Girls can work Out-Call on their second jobs.

If we simply pretend that any therapist is capable of damaging a client's competance to consent, but allow therapies to be practiced on those who've already consented, then Sex Workers would still be legal to use Massage, or Brain Surgery, but not to advertise such services.

We could train Sex Workers as Paralegals, and Law Offices would be the places to go, as they are now often described.

I don't think Private Modelling is the World's Oldest Proffession, but Ishtar the Har might have initiated Western Civilization.

'Prostitute,' btw, is a polite euphemism which, in its precise meaning, would better describe Lawyers and Politicians. It means 'One who stands forth, as before the Unworthy.'

shadow prostitution, but why is prostitution illegal in this day and age anyway? If it wasn't illegal we wouldn't need these somewhat outrageous laws against message therapists.

Prostitution has a long history (the worlds oldest profession?) and has a more recent history (within the last 100 years) of VD rates and the public health risks. However, I fail to understand why it is still illegal in 49 states. While condoms don't protect against all VD (warts and crabs come to mind) , they are certainly more effective than what "abstinence only" education say they are.

Black markets are never good for commerce or for the people they purport to protect.

As a LMT, I understand why the law was put into place in a profession where there has been so much trouble with "practitioners" who are nothing more than prostitutes. I agree that there should be standards for protecting the public. A Massage Therapist is dealing with clients who are vulnerable, just as Doctors do, and there is potential for abuse. That being said, however, I don't believe that the law should be any stricter these days than for a Physician, etc.
I do take issue with this woman saying that she didn't know about the law. I'm sorry, that just cannot be true. When we are trained, the laws are very clearly explained. And anyone who is licensed keeps up with legislation concerning Massge Therapists. These laws are part of some continuing ed (which we must all keep up with in order to practice) , as well as in the trade literature and newsletters from trade associations. She knew, she just ignored it, and hoped it wouldn't come back to bite her on the butt. It probably wouldn't have, except for the guy's ex-wife. I wish her luck, though. She's probably been through quite enough punishment already.
