Conservative Group Unlikely To Be Penalized For Ad Mocking Candidate

Title: CONSERVATIVE GROUP UNLIKELY TO BE PENALIZED FOR AD MOCKING CANDIDATE
A television ad bought by the conservative Carolina Stompers — which mocks City Council candidate Elaine Lite for participating in a Wiccan prayer — may not force the group to register as a political committee.
The commercial doesn’t explicitly ask voters to reject Lite, the message that would legally identify it as a campaign expenditure, according to the state elections board.
“Do they ask you to vote for or against that candidate? That’s the question,” said Kim Westbrook Strach, the board’s deputy director for campaign reporting, whose investigation of a complaint against the group brought her to Asheville to talk to its founder and look at its records.
The group’s ad doesn’t tell viewers how to vote Nov. 6, although it describes Lite as a candidate in its voiceover parodying MasterCard’s “Priceless” ad campaign and in its misspelled subtitles making fun of “Pegan witches” over footage of the Aug. 3 prayer near City-County Plaza.

The ad clearly doesn't violate any campaign rule. It doesn't tell you who to vote for or who not to vote for. It does, in fact, show an actual newsworthy event (i.e. a politician taking part in an activity) . I would expect some people would be more inclined to vote for the candidate based on the ad, while others would become less likely. It doesn't matter if the makers of the ad fall into the "less likely" group. They played by the rules. Whether they are mocking or not, they did a public service as far as I'm concerned by giving the public more information.
