Nebraska Supreme Court Upholds Law Requiring Infant Blood Testing

Author: Sioux City Journal Source: Sioux City Journal (IA)

Title: HIGH COURT UPHOLDS LAW REQUIRING INFANT BLOOD TESTING
The Nebraska Supreme Court on Friday rejected a religious challenge to a state law that requires mandatory blood testing of newborn babies.
The court rejected an appeal by Josue and Mary Anaya of Omaha, who were ordered by a judge in December 2003 to submit their newborn, Rosa, to the metabolic tests. The Anayas, who are fundamental Christians, argued that compelling the tests violated their religious beliefs.
They cited the Bible, saying "the life of the flesh is in the blood" in refusing to have the baby tested.
The Anayas also testified that they believe that taking a baby's blood could shorten its life.
State health officials say the test, which consists of pricking an infant's heel to draw five drops of blood, is necessary to prevent several metabolic diseases that can cause severe mental retardation or death if left undetected.

I figure that those that don't want their kids tested should be allowed to avoid such a practice. But the parents should indeed be told what the test actually provides and what risks will be run if the tests are not completed. Then if they still don't wish it, fine. I sure wouldn't want anything foisted upon me that I didn't want. We already pay a lot more than we need for certain procedures as it is. It would be nice to say no once in awhile.

"In a friend of the court brief, American Civil Liberties Union attorney Amy Miller said the state cannot prove that the tests are necessary."
"Officials say those diseases put a strain on families and on taxpayers who often must pay for long-term care of the disabled."
How about if the parents pay the difference of Insurance, reflecting best Estimation of Cost rather than putting their children at prophesied risk. It's not like Cassandra is always wrong.
"Ray and Louise Spiering argue that the mandatory blood test would violate a tenet of their religion, the Church of Scientology. In the Church of Scientology, it is believed that babies are best served with seven days of silence after birth."
