Update: South Dakota Abortion Bill Passes Senate, 23 To 12

Author: Terry Woster and Megan Myers   Source: Argus Leader (SD)

Title: NATION'S EYES ARE ON S. DAKOTA AS ABORTION BILL PASSES SENATE, 23 TO 12

A contentious abortion bill passed the South Dakota Senate late this afternoon. The vote was 23 to 12.

Lawmakers spent much of this afternoon debating the bill, which has thrust South Dakota into the national spotlight.

House Bill 1215 would ban most abortions in South Dakota.

Republican Sen. Bill Napoli of Rapid City said, "This bill is as straight forward and as honest as it can be. It just says no more abortions unless the life of the mother is threatened."

The wise thing to do might be to get some sane limitations on abortion passed along with enhanced state support of pregnant mothers with more programs like WIC. The vast majority of people (IMO) want to see less abortions without outlawing abortions altogether. The Pro-Choice movement is about to become a victom of it's own success. Allowing some sever limmitations on 2nd and especially 3rd trimester abortions is probably the best way to block Pro-Lifers from being able to outlaw abortions altogether.

These kinds of things are just distressing. Even though it is only one state and it does not neccesarily mean the end of it all, the fact that there are so many people who still think it's the government's job to regulate our reproduction is frightening. What I find somewhat amusing, though, is that the number of abortions in this country have been decreasing steadily across several decades all on their own without any law to force it to be so. Shouldn't that be telling these people something? Perhaps it should be telling them that people aren't using abortion as a 'murder' tool as they so believe it is?

Makes Me Kind Of Glad... Feb 24th. at 12:12:08 am EST

that I'm 47, even though I don't really want to be old. I am so sickened by all that is happening in this country that is turning back the clock. It makes me SAD, especially for all those who worked so hard for our rights and freedoms. So much seems to be going down the sh*tter because of the constant wars that some group of christians somewhere, creates on a daily basis. This week alone I read several articles, that I choked on. One was on the pastor who intends to turn SC into a christian state. Apparently, he isn't giving up on that and it seems his group is growing. Then you have that new Catholic town that is growing in SW Florida near Naples. They're promoting their "values" laws and is seeking a pharmacy to come in that agrees NOT to sell contraceptives. It just seems like one after the other. All of you who don't want to be forced into a christian nation, how many of you sat on your asses election day? I don't know the answers, but I am distraught. I will never submit to christian law and I hate to say am losing what little tolerance I have left of them. I spend very little time home due to my occupation, so it's hard to get as active as I'd like to in countering this stuff. But I do want to help. Any ideas anyone?

Even though I am male, I am frightened about this turn of events. I believe in abortion. I have met many rape victims, many by incest rape, a person who had to get an abortion to save her life (she was a born again too, figure that) , and have had friends in high school have kids that they did not want.
My theory is that the child will be unwanted and mistreated (as with my all of the above circumstances) , have bad DNA (as with incest) , or the woman will be left dead or emotionally scarred (as with the safety of the mother and rape victims) .
They will come after same sex marriage, then gay adoption, then people with chemical imbalaces in their brains due to genetics, then pagans. We best be ready for war.

Like Alkhemy, I'm personally against abortions for convenience. However, it's not my job to tell anybody what they ought not to do.
I think that Abortion, as with other things should be fought in churches, and not in our laws.
There are those who do not see a fetus as human life. Though I am not one of these, I think the best that I can do is to educate my children to my standards. Trying to turn my neighbor into a criminal for her own beliefs is just plain wrong.
I also would hate to see what would happen to women in this country if Rowe V. Wade is overturned. I don't want to go back to the days of back-alley abortion clinics. This is a terrible decision for women and for the country as a whole.
I just hate to see fundamentalist christian values being imposed on our country. We are moving backwards in LGBT rights and reproductive freedom. I don't expect it to stop there.

more important is happening. The religious right is being used to set up anti abortion bills which sets the precedent that the government rules our reproduction. Later we will have an 'emergency' whereby the government will decide who gets to have a child and who doesn't. All they have to do is wait about 20 years for the young people to forget what our rights used to be.

Must Remain Legal Feb 23rd. at 2:12:07 pm EST

alkhemy (Sunland, California) - Email Me

I am very much not in favor of abortions that are not medically necessary for all kinds of reasons - the psychological trauma alone is horrific, let alone potential physical complications, plus I hold all life to be sacred.

But I also am very much in favor of abortions being legally available to those who need one. I don't think for a minute that anyone WANTS to have an abortion, but sometimes they are necessary, sometimes they are the lesser of two evils, and even when it just seems to be the easy way out, I firmly believe that it is the right of the person concerned to choose what they are going to do.

So I guess you could say I an pro-life AND pro-choice.

I Am More Upset.... Feb 23rd. at 12:39:38 pm EST

Rev. Jeanene Hammers (Hillsboro, Oregon) - Email Me

... over some of the comments here that the article itself.

*I believe that Roe vs Wade should be overturned. Like many other laws, it's the federal government sticking their collective noses where they do not belong. This is a States Rights issue - not a federal one.

*Some people seem to think that anyone who is pro-life is also against same-sex marriages, same-sex couple apotions, and other matters. That is an untrue generalization.

*For the record, I am against abortion in all forms. I really do not care if same-sex couples get married or not. As for adoption, any couple, regardless of who they are, needs to go through a rigorous screening process. If they pass, then they can adopt.

*I do have an issue with this law - namely that it is not being voted on by the residents of SD. My inclination is that if it's voted on, then deemed unconstitutional, it would also remove current laws from the books. By just voting this way, it lessens the amount of time that could occur with no abortion laws.

SICK SICK SICK Feb 23rd. at 11:56:48 am EST

Jeanne Lisbet (Calgary, Alberta) - Email Me

This is horrific. This is sick.
The previous poster is right in one sense.. "We" didn't think it would happen to us.
I didn't see how the barbarians at the gate could possibly muster enough power to pull this off. But then, what, forty years ago, Afghanistan was one of the most advanced and cosmopolitan countries in Asia; women had rights, had jobs, freedom... and now look at it. How quickly things change when we live in the illusion that "it can't happen to me."

I feel like one of thise hobbits in the shire watching fires grow in Mordor, thinkin', "Hey, y'know, that thing's not getting any smaller..."

As I once read in one of Marion Z. Bradleys books: No woman is free to bear a child unless she is also free to abort it. First they come for the pro-choice, then the gays... who's next?

....And the fact that they voted down the provision protecting rape & incest victims... wow. That's especially cruel. (Though I'd always thought it was hypocritical to exclude that circumstance if you're going to argue that "its a child not a choice".... but hey, in SD that point is rather moot now.)

What's next?

Brightest Blessings to all those under the yoke. You have my sympathy & solidarity.
(And my country if you ever feel the need! We gots lots o' space! and the winter's not so as some make it out to be..)
Yours in Peace

Sigh... Feb 23rd. at 11:50:33 am EST

I am so tired of these people trying and apparently succeeding lately to push their agendas on the rest of us. And there are people who say that they aren't a threat just a lunatic fringe and we are merely being paranoid like Chicken Little, while laws get made banning same sex marriage, abortion rights and now gay adoption?
*shrugs*
When will conservative Christians learn that they are not the only people on the planet and that their ways are not the only ways? I am so tired of hearing them say how "America is a Christian nation and our Founding Fathers were Christian", blah blah blah.
Um, no, they weren't. The Founding Fathers were deists, not theists and apparently such folks are also ignorant of the Treaty of Tripoli, which explicitly states that America is NOT a Christian nation.
It is becoming scary to live in this country, watching our rights slowly being tossed away and having Biblical law gradually enforced upon us all. So much for freedom of worship, eh?
Sadly, we seem to be following in the footsteps of the theocratic nations of Islam and that can only bode evil...

I'd Support This Bill... Feb 23rd. at 11:06:50 am EST

Mysteries Child (Garfield, West Virginia) - Email Me

... if I believed it would really make a difference in the rate of people stupidly creating children they don't want because they don't think first and don't believe it can happen to them.

It won't. Every man or woman who forgets to swallow the Pill at the same time every day (not my favorite method) , doesn't want to bother with the mess made by contraceptive foam, says a condom ruins it (STILL the only method besides abstinence capable of preventing some STD's) , or et cetera still thinks it won't happen to them.

They'll pull out, they're using the rhythm method (effective if you're among the minority of the population that's either very regular or very good at detecting ovulation 36 hours before it occurs; completely useless for the rest of us) , they'll stand up the minute they're done, they'll douche with soda and aspirin right after sex, and a thousand other things they heard in the high-school locker-room.

Want to reduce the abortion rate?? Make emergency contraception ("The Morning-After Pill") available to every woman in the country at low to no cost.

Is it agreeable?? Not really-- I've done it twice; it made me violently ill, and I consider it just an extremely early abortion. Is it cleaner than a 12-week abortion?? Yes. In so many, many ways.

I'd say standardize sex ed and require it in every school in the nation (including homeschools) ...

...but we're back to the "It can't happen to me" thing. One of the few things my high school had was decent sex ed (probably owing to the fact that the health teacher was both a liberal and a lesbian) . Condom use was drilled into our heads.

We still had the highest rate of teen pregnancy in four counties. Why?? For starters, we had the highest rate of poverty in four counties, too. When you're young, pissed off, rebellious, and it's what your grandmother, mother, and sister did before you, all the education in the world isn't likely to adjust your attitude enough to make a real difference.

There's a lot more to it than reproductive rights, a lot more even than the right to enjoy sex on your own terms. I've seen quite a few abortions (five to be exact; my mother had three for various reasons and I've seen two friends go thru the process) and can say that it happens for all kinds of reasons.

My mother's last one happened because she was dying of cancer, on all kinds of horrible drugs, yet could still manage to get pregnant. The other two happened because the guy du jour didn't want to wear a condom and she didn't want to piss him off.

Same deal with my friends. One was a pretty responsible girl who probably would have been OK raising a kid-- she just didn't have the self-esteem to either get contraception herself or tell him to wrap it or put it back in his pants and shut up.

The other had already had two children taken from her by Social Services for either abusing them or allowing her boyfriend to do it, and primarily chose abortion because she was pretty sure it was a white guy's baby and didn't want her two African-American boyfriends to know.

In the end... I'm not a supporter of abortion. I think it kills children and leaves behind a welter of scars and lessons unlearned.

However, I still believe in an individual's right to choose the scars they will bear and the karma that will dog them until the lessons are learned.

I also believe that people will find a way to get it no matter what...

...and that's going to mean a lot of people dying from inept illicit abortions and poisoning from trying various herbal methods of inducing miscarriage.

It's also going to mean a lot of unsuccessful abortions that result in children who come into this world with some really serious problems (a mother who doesn't want them being actually one of the lesser compared to massive brain damage and et cetera) .

I'd believe in banning abortion...

...if I believed it would mean people would think first and ejaculate later. We never have, though, and I don't believe we ever will.

Be careful out there, and don't forget to wear your raincoats.

Choices? Feb 23rd. at 10:53:36 am EST

Ahr-Ohn (Bridgeport, Connecticut) - Email Me

The Jane Collective might well be why Abortion was legalised in the first place. The original campaign against Abortion, that Life began at Conception, was a monopolistic move of the AMA, driving Abortionists out of Business. Pro-Lifers, protesting the Family Planning Clinics, which the AMA has declared Safe, usually see an ambulance every week.

When Abraham Flexner wrote Carnegie Mellon Report #4, Medical Education was dismal, and this was seen as a reason to demand Doctorates of Physicians, but that report described Medical Education as an inferiour alternative to Medical Apprenticeship, and the Jane Collective took to training Abortion Ministers as Apprentices.

I'd like to see Roe v Wade ignored, and Abortion Regulation should be adjudicated on a State by State basis, in accordance with what Sanity their Legislatures are elected to display.

Why have we different standards for Abortion, and Drug Abuse?

Death is One Choice; Life is a Multitude.

Opinion Vs Reality Feb 23rd. at 10:52:39 am EST

L Henderson (Upper Township, New Jersey) - Email Me

Sen. Julie Bartling said:

“In my opinion, it is the time for this South Dakota Legislature to deal with this issue and protect the rights and lives of unborn children,” she said during the Senate's debate. “There is a movement across this country of the wishes to save and protect the lives of unborn children.”

The article also said:

Senators who favor the ban on abortion also killed an amendment that would have sent the issue to a public vote...

If she is so sure of the public’s wishes, then why is she so afraid of a public vote? Perhaps this “movement” isnt as big or popular as her words would lead people to believe.

Lady-hearted Mojo (Irving, Texas) - Email Me

"Republican Sen. Stan Adelstein of Rapid City had tried to amend the bill to include an exception for abortions for victims of rape. The amendment lost 14-21.

“To require a woman who has been savaged to carry the brutal attack result is a continued savagery unworthy of South Dakota,” he said.

Republican Sen. Lee Schoenbeck of Watertown objected.

Rape should be punished severely, he said, but the amendment is unfair to “some equally innocent souls who have no chance to stand and defend themselves.”

Sick, sick, sick....that's all I can say after reading this. Just when I think our government, state and federal, can sink no lower, they find a way to do so.
