Inmate Sues Over Religious Items

Title: INMATE SUES OVER RELIGIOUS ITEMS
An inmate serving life in prison for a torture murder that sent two co-defendants to death row wants a federal judge to approve a toy sword and other items and privileges for the practice of an ancient European religion.
Darrell Hoadley, of Lead, who was convicted of murder for his part in the 2000 slaying of Chester Allan Poage near Spearfish, filed the handwritten complaint in U.S. District Court. He lists himself in court documents as counsel elder of the Asatru religious group.
The state has not yet filed an answer to the complaint. The Department of Corrections and state prosecutors do not comment on pending litigation. No court date is scheduled.

Those who are promoting retribution by denying inmates their religious rights are in effect promoting denial of my rights and their own, as under existing legal standards, inmates retain rights in jail and only face limits on practices which conflict with serious institutional special needs. It's often prison litigation, or other cases involving marginalized people, which set the precedents and define the boundaries of rights applicable to all of us in our civilian existence and daily lives.
Personally, I agree that this inmate should be able to seriously practice his identified religion without loads of theatrical props. However, it's sad that rabid fundie pagans fail to respect how some people with limited abstract visualization skills do far better with physical props for rituals. Beyond that, case law important to identifying many splinter religion related rights clearly holds an individual's interpretation of the demands of his own path to trump the views of clergy in his own lineage, or other official or common interpretations of the same nominal religion.
If pagans often victimized by bad laws or their interpretation are so quick to promote ignorance of case law and supremacist excuses to violate rather than uphold rights of others, what does that say about how little we deserve each other's trust or respect, or could trust fellow pagans on a jury or at the polls?

with the majority of comments here. This man is in prison to be punished. If he's learned his lesson, fine, but it's not up to the government to give him anything to facilitate his religious practice. Same goes for anyone of any religion. The prisons wouldn't have to worry about this if they didn't already give so much to the Christian prisoners. So, that in my opinion, should stop. Also, as someone else pointed out, they are only tools. He should be able to practice just fine without the props.

I could care less about this guy, or any of the many people finding Paganism in prison. I don't know why we would want any of them, except for a seasonal divination done old school. Slice him open and read the portent from his entrails as they unwind. Of course, I'm sure mine is the minority opinion.

I have to say, that while I agree that certain requests are not ones to be fulfilled for safety reasons, like the plastic sword, he should be allowed to have certain other religious tools, and the time to practice his religion to the best of the ability of someone in his position. No the article does not say that he is sorry for what he did, but who's to say that he didn't apologize, and that he doesn't feel remorse. It is not our place to judge him for his actions, that is for the Gods to decide. Perhaps this is how he is trying to honestly turn his life around and religion will help him do that. Just a thought, I may be being naive, but I am trying to be positive, and not judge someone I don't know, who's story I only know a PORTION of. Blessings. Raevyn

WHAT!!??? This guy is in prison for torturing someone and dropping rocks on the guys head for awhile until he died. And he wants all this stuff? It was also mentioned that his cardboard swords keep dissappearing. Do we really need plastic ones disappearing in that population?
Also, if this guy has been practicing this for 40 years as he says, what is it that he forgot about whilst he was standing on Poages neck and trying to drown him? I rather think that prison populations have way too many dangerous folks in them for the folks trying to keep some order to be worrying about where plastic weapons have gone. Folk who are locked up for stuff like this should not be given anything they can use to hurt anyone else. No way.

Better to deny him a toy weapon- then to find later that he has fashioned a real one out of it. It may be that he means no harm with it, but no one should take the chance. He's in jail for murder. And while I will not deny him his religion, I would deny him even a faint chance to harm someone else.

This nithing is not a follower of the Nine Noble Virtues. He is about as Asatru as a Klansman is Christian. If he pretends to follow the Norse/Germanic ways then he is headed for Nifelheim, where Hel punishes the murderers. Nothing he does will lighten his wyrd. He is a nithing criminal and his deeds are a stain on the holy name of Asatru. Let him rot in his cell and die as dishonorably as he has lived. Do not look to convicts and torturers if you wish to see a good example of what Asatru is really about. Look to Freya Aswynn, Diana Paxson, Galina Krasskova and other non-racist, law-abiding and respected leaders. Not all of us espouse violence and cruelty. Our religion, with it's lawspeakers at Thing, contains the very foundation of the modern American legal system.

If he wants to practice his religion, according to First Principals, he could always hang nine days from the Tree of Life...
Does Mr. Poage get a sword, at least to die with?
"Though Hoadley opted to stand trial for Poage's killing, the other co-defendants pleaded guilty and were sentenced to death. Briley Piper, of Anchorage, Alaska, is appealing the sentence. Elijah Page, of Athens, Texas, has ended his appeals and is scheduled to be executed the week of July 9."
As a last request, Mr. Page should ask to see The Order of the Phoenix, but the ending would still be better than a sentence of Death by Old Age.
The Cardboard Sword keeps dissappearing, and I wouldn't trust those guards with as much as a plastic Jedi Sword. Does the Incense imply that this prisoner is to be trusted with Fire?
We should hear of these things, to see that the Karma is ecchoed, rather than earned. If the eccho of Karma is unpleasant, savor it, for Wisdom.
"The Governor has given you a special deal, just because you're Asatru. Allow us to give you these shots of Potassium Chloride, to assure you won't commit any further crimes, and we'll let you earn your freedom with these swords..."

How can someone who did what this man did do another human being...who is not saying he is sorry or regrets his behavior or anything of the like, only that he wants items that in a prison situation could kill another human being.....Think about it!!!!!!! Everytime an article is written about someone like this their "karma" their "spirit" whatever you want to call it is released and passed around and their crimes and hatred of humanity is furthered...........just STOP paying attention and guess what maybe some of the violence will end!!!!!!!!!!
