State Officials Want Hoadley Religion Lawsuit Dismissed

Title: STATE OFFICIALS WANT HOADLEY RELIGION LAWSUIT DISMISSED

A federal judge should dismiss a lawsuit filed by an inmate seeking a toy sword and other privileges for the practice of an ancient European religion, the lawyer for state officials argued in court documents.

Darrell Hoadley of Lead, who was convicted of murder for his part in the 2000 slaying of Chester Allan Poage near Spearfish, filed the handwritten complaint in February in U.S. District Court.

He listed himself as counsel elder of the Asatru religious group.

Hoadley said he's suing prison staff because they have denied some of his requests while members of other religions have received similar privileges.

I really don't think it is intolerant to say he doesn't need/deserve/ should get the tools. What we need to seperate is that ok, yes he is entitled to have most (ok, sauna? get in line pal) of the things on the list, but he is still in there to be punished. He is, in fact, a CRIMINAL, and I truly believe this started out as an innocent plea, but has turned into a publicity stunt.

Botttom line is I have seen inmates get a bible and a crucifix, maybe some sort of annointing oil. How many earthly items do you honestly need to practice your faith?

...all over the world who can achieve inner peace, and celebrate their faiths, with far less at hand than he has in his prison.

I would respect him much more if he simply presented himself to his gods, asked for their guidance, and then listened to it.

Having committed a crime that is heinous enough to put its other participants on death row, (he took another's life, for gods' sake!) he has a lot of listening, and learning to do, and precious little demanding.

Gotta love it. A majority of his requests are surprisingly reasonable for magical ritual practice...the only absurd one is the sauna.

Shivs can be made out of most everything...but a hollow plastic sword is probably one of the least likely.

Hell, prisoners can receive college educations while on death row, but he can't have some cheap religious supplies?

I'm sorry, but if Mumia can get three doctorate degrees on my dollar while on death row, I can spring for the $1.50 sword this guys is gonna get...and, hell, even if he somehow manages to shiv somebody with it, he'll more than likely shiv another inmate.

Two birds, one stone.

He can have most of what he wants - at his expense of course. They said he can't have the sword because he did not fill out the forms for it properly - and make a proposal of how he would acquire it - I suppose if it was a nerf sword he could not hurt anyone with it.

The main point of the prison folks is that HE must provide the things he wants - their list of what he can have relating to his claim of religion seems to cover anything I would need for mine. Wanting an outside space with tree and sauna is going a bit far though.

This guy is just angling for more privlleges and wants attention. Let him buy the stuff that is allowed and make do for the rest.

Lets see the guy is in prison for murder adn wants a sword...even a toy sword. Nope sorry dont think so.

Books on his religion..I can back that. Weapons or toy weapons in a prison..nope

Dude you are in prison. You have to earn what you get. They are not just given to you.

I do not have a lot of respect for inmates that have commited violent crimes.

So do not be upset if I do not shead a tear at his lack of spirituality before prison, and his sudden desire to connect with God now

There are more Saints on Death Row then in churches, circles, adn groves

Now, I could see the Thor's Hammer pendent, but this guy has a flippin christmas list of Pagan goodies going on. He is in there to be PUNISHED. If he was serious about his faith, he would realize it doesn't take tools, and goodies to practice it.

Am I wrong for thinking this? Am i being to hard on him? No, I don't think so, because at the end of the day he is still an inmate, he is still in a cell because he committed a crime. A pendant is one thing, an entire store of stuff is a little much.
