Title: U.S. SUPREME COURT DECLINES TO HEAR APPEAL ON VIRGINIA'S TOUGH ANTI-SPAM LAW
 The Supreme Court has passed up a chance to examine how far states can go to restrict unsolicited e-mails in efforts to block spammers from bombarding computer users.
The high court without comment Monday rejected Virginia's appeal to keep its Computer Crimes Act in place. It was one of the toughest laws of its kind in the nation, the only one to ban noncommercial -- as well as commercial -- spam e-mail to consumers in that state.
The justices' refusal to intervene also means the conviction of prolific commercial spammer Jeremy Jaynes will not be reinstated.
His 2004 felony conviction was the first in the United States for sending bulk unsolicited electronic messages.

I have heard of this argument before: "What is really spam? One person's porn is another person's nudity." The art discussion is comparing apples and oranges in my opinion. I am a long-time user of the Internet and a very advid opposer of spam. For anyone that wants to cry freedom of speech they need to realize that I may not want to hear what you have to say especially if what you have to say is trying to sell me some illegal placebo Viagra from China.
Spam, also called UCE (Unsolicited Commercial Email) , says it all. We don't need laws with multiple sections and subsections trying to define spam. The term says it all.
Unsolicited = The recipient did not solicit or request the email.
Commercial Email - An email containing an advertisement for the sale of product or service or an email containing a message that will lead to the sale of a product or service or exchange of money.
There you go. My simple definition in whether it's unsolicited or not is this question, "Did I personally request to receive anything from you?" Some spammers like to say, "Well they signed up at a website that authorized the receipt of email from third-party companies." I ALWAYS unselect any option that says anything related to receipt of email from third-party companies.
On the advertising and marketing side of the fence it is highly recommended that you build your own mailing list. It is not that hard to gather your own mailing list. There are tons of legal and free (as in free cup of coffee) ways of building your own mailing lsit.
As for me mentioning China in the beginning, I wasn't picking on China but stating the truth. All of the scams and spams I receive trace to APNIC (Asia Pacific Network) . I have forwarded tons of spams to CNOC (China Network Operations Center) and I can check back months from the date I forwarded the spam and the viagra or spam website is still up and operational with the same IP address.
Personally I'd like to see a hard labor work camp set up for spammers.

He stays behind bars.. That is the probem witrh spam.. how des one determine what is spam.. it's like porn you know it when you see it, but really try to define it.
What is porn to one can be "art" to some one else.. Spam to you and I could be an "advert" to some one else.. Though I suspect that some one else would be a resident in a place where people are happy all day long and make baskets......Then again maybe not...
