Vermont Bills Would Limit Public Access To Certain Records

Title: BILLS WOULD LIMIT PUBLIC ACCESS TO CERTAIN RECORDS
State legislators will consider at least two bills during their upcoming session that would limit access to court records and restrict information contained in public death certificates.
The court-records bill, sponsored by Sen. Richard Sears, D-Bennington, would bar the judiciary from posting legal paperwork on the Internet. The death-certificate bill, sponsored in the Senate by Sen. Bill Carris, D-Rutland, and in the House by Rep. Peg Flory, R-Pittsford, would wipe Social Security numbers and cause of death from the publicly available documents.
Supporters said the new laws are needed to protect sensitive, private information. Open-government advocates said the state should restrict access only under limited circumstances.
Both measures address a prevalent, timely topic: the competing interests of individual privacy rights versus the public's right to know.

If the bill would prevent people from committing identity theft by stealing dead people's SSNs, what happens if there's a mistake?
Granted, lots of people have unusual names nowadays, but what if some bureaucratic office tells John Smith of East Main Street, Springfield, NY that his mortgage application is being denied on account of his death last year, and by the way he should look forward to a visit from the sherriff for fraud--when it's the other John Smith who lives on East Main Street, Springfield, NJ who died.
How would you go about fixing that kind of error, or proving that you did NOT commit identity theft and it's merely a one-letter mistake, without an SSN on the death cert.?
