District Judge Rules For Native Religious Rights In Eagle Case

Author: Ben Neary, Associated Press   Source: Indian Country Today

Title: DISTRICT JUDGE RULES FOR NATIVE RELIGIOUS RIGHTS IN EAGLE CASE

Saying the federal government pays no more than lip service to respecting the religious beliefs of American Indians, a federal judge in Wyoming has dismissed criminal charges against a Northern Arapaho man who shot a bald eagle last year for use in his tribe's Sun Dance.

Lawyers for Indian groups say the order by U.S. District Judge William Downes should prompt the federal government to streamline its program of parceling out dead eagles and eagle feathers to Indians.

They say it also should prompt federal officials to begin a serious dialogue with tribes about allowing tribal members to kill some eagles for religious purposes.

Federal officials, however, filed notice in November that they intend to appeal the judge's order.

The reason it's illegal to keep eagle feathers is the same reason the government demands that anyone who finds a feather sends them back in. Almost all of those feathers are distributed to Native American tribes for religious use. The problem is that red tape stops them from reaching their destination. Maybe if the government had kept their word and distributed those feathers, this wouldn't have had to happen.

It's not the Native Americans that endangered the animals on this continent...

''Although the government professes respect and accommodation of the religious practices of Native Americans, its actions show callous indifference to such practices,'' Downes wrote. ''It is clear to this court that the government has no intention of accommodating the religious beliefs of Native Americans except on its own terms and in its own good time.''

Isn't the tradition that the Eagle should give the feather, in its own good time?

''The way it was told to me, the eagle takes the prayers that we have here, takes them up to the Creator,'' Friday said. ''That's one main reason that we believe in it so much, it does that. It's an offering - you want it to be nice.''

The prayer received is that, we don't need no stinkin' Eagles. So White Man's ammunition is used, as an offering; you want it to be nice.

The Eagle is an endangered species because DDT converted to DDE, and made the Egg Shells thin. Red Man wants to finish what the White Man started. I read that there are 5,000 beggars waiting for the Government to feed them.

First, let them die, and live to tell about it, then let them study what comes.
