Title: COURT DECLINES TO CONSIDER CHALLENGE TO CLINTON MONUMENTS
Former Interior Secretary Bruce Babbitt praised the Supreme Court for refusing to consider a lawsuit challenging the creation of national monuments in five Western states.
The court reinforced the president's power to protect federal lands, Babbitt said Monday.
''I would suggest this is good news for future presidents,'' said Babbitt, who oversaw President Clinton's designation of 19 national monuments under the century-old Antiquities Act.

Looks like the asphyxiating "embrace" this particular executive branch had on the judicial branch is coming to an end. Thank you Supreme Court Justices. And may a wise seperation of powers flourish and endure--for it's our politic's greatest defense. And insures our legacy to future generations.

Score one for the parties who are trying to save some of this wonderful continent, rather than pave it over with shopping malls and other corporate enterprises. It's a great day knowing that the court system upheld the raison d'etre for these National Monuments.

The thing that gets me...
These lawsuits are, of course, being brought up by one of the special interests that is trying to get the most benefits from the Bush Administration: The Logging industry.
To call these new national monuments "tinder boxes" is a little bit inflammatory. (har!)
Yes, i agree, Sometimes forests need a little help clearing brush and thinning out...BUT, thats what forest fires are FOR! these "gentlemen" would have us believe that they are going through and only taking out a few trees here and there, and, of course, they really have the environment's interest at heart!! all they are trying to do is help the forest!!
Yeah. And the King of Siam is cooking me dinner.

Notice that the only presidents to NOT use this power were Reagan and both Bushes . . . Probably the three most greedy, selfish and ecologically (amongst other things) dangerous presidents ever elected (or appointed) .

This may be simply the Bush Administration not wanting to give up power, rather than any concern for the national monuments. Given the logging friendly attitude of the Bush folks, it may just be that they didn't want other legal entanglements, or they had other loggers in mind.
