4 Amish Bishops Charged With Not Reporting Abuse

Title: 4 AMISH BISHOPS CHARGED WITH NOT REPORTING ABUSE

Four Amish leaders in southwest Missouri who chose to "shun" an accused child molester in their community rather than report him to authorities were charged Tuesday with failing to report the sexual abuse.

Webster County prosecutor Danette Padgett said all four are bishops and face one misdemeanor count each of failure to report child abuse as a mandatory reporter.

Under Missouri law, people with "responsibility for the care of children" are required to report suspected child abuse. Examples of mandatory reporters under the statute are doctors, nurses, social workers and teachers and ministers who are not engaged in a "privileged communication."

"Padgett and Cole said they believe the bishops were told about the alleged abuse by Schwartz's wife, which would make it a nonprivileged communication because she was not "confessing."

But Worsham, who also represents Johnny Schwartz, said prosecutors are using an overly broad definition of the mandatory reporter law."

Amish Community is one of spiritual nurture, and all communication is privileged. If the evidence against this brother, other than hearsay, is his public confession, before the congregation, how is that not a spiritual confession, and Privileged Communication?

The charge is that a Bishop heard of this abuse from a wife, which implicates issues of Spousal Testimony, another legal no-no.

Bishop, meaning Episcopus, the Latin for Supervisor or Overseer, is overseer of a community of spiritual nurture, in this case, and whether he's a religious or civic leader is being questioned.

He's both Clerical and Civic Leadership, but Confession in Church remains under Seal of Confessional, Conspiracy with Spouse is still protected from Self Incrimination, and Genocide seems, in this case Prosecutorial Misconduct. Had the Congregation, or its Bishops, discouraged legal confession, either of the molested child, or the molestor, that would have been Suppression of Evidence.

Why is the charge one of failing to tender hearsay evidence, rarther than of suppressing evidence?

The story of the Amish sheltering a child molester is not the only wrong the Amish regularly do.

Look at how they treat women who do not "submit
' to the abuse the females suffer. One young woman had all her teeth pulled out without her consent because she wanted to speak out about how badly women are abused in Amish communities.

Sexual predators like closed communities like the Amish and JWs because there is the unwillingness by those inside to admit it is happening in their group and their teachings of nor contacting outsiders.

That's also why Jessup and his FLDS taught about child brides to adult men and why Tony Alamo thought he could get away with his "marrying" 12 year old girls as his "brides".

As a Wiccan HP, I am a mandatory reporter. The State regards me as having a responsibility to protect children that goes beyond my oath of confidentiality. Looking at this I agree, and I will turn in and testify against child molesters. Further I believe that this is also the will of the Goddess.
The Bishops believe that their law is the only law and that they have no responsibility to the rest of society that is not Amish. I do not agree and think that this should be brought home with legal punishment of some type.
