Title: WICCAN SUES BATH AND BODY WORKS OVER FIRING

All Gina Uberti wanted to do was take Halloween week off in October 2008 and head up to Salem, Massachusetts with other Wiccans for a festival.

That’s apparently what Wiccans, especially those who live near Witch City, do during this major Wiccan religious event.

The Bath and Body Works district manager put in for her vacation time, as she had for the previous six years she worked for the company. Her time was approved, she said, she was all set. At least she thought she was, according to a lawsuit Uberti filed against Bath and Body Works last month.

The problem for Uberti’s vacation plans, and her employment, began with a management shuffle and a new boss, she claims.

The Wiccan's manager must be a card carrying Xian....the only reason I say this is because she's stupid.

I hope the witch wins her case and her former manager gets her ass fired...hopefully around Xmas time...now that would be a nice gift the Baby Jesus could give the manager.

She stated that she has taken this vacation several times before and Bath and Body Works had no problem with it. It's not a Corperate issue, it was this one manager's issue, and she (the manager) should be fired over it.

The way I read it, the new manager came in while Uberti was in Salem (the so-called "Witch City") . AFTER Uberti returned from her vacation, the new manager said that the vacation time shouldn't have been approved by the old manager....

If the new manager came in before Uberti left on her "pilgrimage", the issue of her taking vacation during the "major redesign" should have been brought up at that time. NOT after Uberti returned to work.

By the way, 4 November 2008 was a Tuesday. The week of 31 October 2008 ended on 1 November, a Saturday.

As someone else has pointed out (in the "comments" section on the article's webpage) , this isn't so much about religion, as it is about the right of employees to take vacation when they wish to -- especially when that vacation is applied for and approved well in advance. In Uberti's case, her vacation was approved 6 months in advance.

This case seems to be all about Employees' Rights, not the freedom to worship whatever religion a person happens to choose.

What kind of emergency could possibly happen at Bath and Body works that would warrant a call? A bath bead mishap? Perhaps a chocolate cinnamon scented salt scrub debacle, or maybe some lotion mayhem? I hope she wins her case, theres no reason she should have lost her job over approved vacation time, no matter what it was used for.

Why does an employee necessarily have to explain why they want some vacation time? Employers are extremely nosey, it's none of managements business what religion an employee practices. If she asked for the vacation a year ago, there's nothing the new manager can do about it.

I don't remember hearing about this. For my wife and for yule/xmas, I spent alotta money there. If there was indeed discrimination involved we should have known about it. What now? Contact the company for their version of the story? They'd lie. This is aggravating to hear something a year old.
